Allegation investigated: Staff are not providing night supervision

Licensing Program Analyst (LPA) Joseph Alejandre made an unannounced visit to conduct the required 10-day visit to begin the investigation into the allegations listed above. LPA met with Administrator Russell Venanzi and explained the reason for the visit. The investigation into the allegation, staff are not providing night supervision, revealed the following. It was reported that there are no staff at the facility at night. No other details were provided regarding this allegation. LPA interviewed 2 staff who reside at the facility. Both staff members reported they are at the facility at night and are on call. Both staff reported that there is a call system so if residents hit their call button it alarms in the staff's rooms and they can go assist the residents in need. LPA verified the signal system works. The facility has 2 stories and staff rooms are upstairs. No residents reside upstairs. LPA interviewed Resident 1 (R1). R1 has been diagnosed with Dementia and could not provide any relevant information about staff at night. Resident 2 (R2) declined to be interviewed. Resident 3 (R3) did not respond to LPA's questions. The Administrator reported that staff are on call from 10:00 pm to 6:00 am. both staff members verified this information. Unfounded Title 22, Division 6, California Code of Regulation 87465(a) states, "The following persons providing night supervision from 10:00 p.m. to 6:00 a.m...(1) In facilities caring for less than sixteen (16) residents, there shall be a qualified person on call on the premises." The facility is in compliance with the night supervision regulation 87465(a)(1). The evidence gathered refutes the allegation. Based on the evidence gathered the allegation is deemed unfounded, meaning that the allegation was false, could not have happened and/or is without a reasonable basis. An exit interview was conducted with the Administrator and a copy of the report was provided. Based on the evidence gathered the allegation is deemed unsubstantiated, although the allegation may have happened or is valid, there is no preponderance of evidence to prove the alleged violation did or did not occur. Type of visit: Required - 1 Year

On this day, Licensing Program Analyst (LPA) Kevin Saborit-Guasch made an unannounced visit to the facility to conduct the required annual inspection. LPA was greeted and granted entry by facility caregiving staff after introducing himself and stating the purpose of the visit. Administrator Russell Venanzi was notified of the visit via telephone. Assistant administrator Tommy Tran arrived later to assist. There are currently five residents in care, three of which are receiving hospice care at this time. LPA observed residents relaxing in their respective bedrooms or in the facility's common living areas. Two resident interviews conducted during the visit. LPA accompanied by facility staff toured the physical plant. The facility is a two-story house with an attached garage, with four private bedrooms and one shared room. The upper level is strictly for use by caregiving staff. There are two shared bathrooms used by residents, one in the hallway and one en-suite from the shared bedroom. Bedrooms appear clean and sanitary. Full rails postural supports are in use on multiple beds at the time of the visit. Hospice plans of care reviewed for two such residents, orders confirmed to be on file. A third resident does not receive hospice care and is stated to not use the rails, which are observed in the lowered position. Staff removed the rails after stating the resident did not use the rails for support. All resident bedrooms have the required furnishings. Bathrooms appear clean and sanitary and are equipped with grab bars and slip mats. Hot water temperature measured at 109F in one of the shared bathrooms. LPA observed the kitchen has a minimum two (2) day perishable and seven (7) day non-perishable food supply. Sharp items, cleaning supplies and the medication central storage are verified to be secure. CONTINUED ON FORM LIC809-C CONTINUED FROM FORM LIC809 The wall-mounted fire extinguisher present is verified to be charged with up-to-date maintenance tag. Carbon monoxide and smoke detectors were found to be present and operational. Emergency water supplies are observed. LPA and facility staff toured the outside of the facility. LPA observed a shaded outdoor seating area with outdoor furniture for resident use. The identified route of egress is free of clutter and obstructions. There are self-latching gates on both sides of the premises. There are no bodies of water present. The facility does not utilize locked perimeters or delayed egress. LPA reviewed five resident records which included all necessary components. No bedridden residents are present. LPA reviewed resident medication records and prescription orders for all residents with no discrepancies observed. Medication requiring refrigeration is however observed in the kitchen's refrigerator which is not secured. Type B deficiency cited. LPA reviewed staff records for five staff members during the visit. Proof of current CPR training is missing for two staff members. Type B deficiency cited. Initial and annual training is documented. Disaster drills are conducted only once annually and the most recent one is not documented. Type B deficiency issued. Staff members are verified to be background cleared and associated to the licensed location. The administrator certificates are current. Based on the observation conducted during the present visit, three type B deficiencies are being cited per Title 22 of the California Code of Regulations. Allegation investigated: Facility staff restricted resident from having visitors

On this day, Licensing Program Analyst (LPA) Kevin Saborit-Guasch made an unannounced visit to the facility for the purpose of following up on the investigation of the allegation listed above and delivering findings. LPA was greeted and granted entry by the facility's caregiving staff after introducing himself and stating the purpose of the visit. Administrator Russell Venanzi was notified via telephone and was unable to assist with the visit in person. Findings were explained and administrator agreed to have caregiving staff sign on his behalf. The initial investigation visit was conducted on February 3, 2025. During the visit, LPA conducted multiple staff interviews and reviewed residents records for the four residents currently admitted at the facility along with an additional resident who has recently passed away. During the investigation, five additional witness interviews were attempted and/or conducted. CONTINUED ON FORM LIC9099-C Unsubstantiated CONTINUED FROM FORM LIC9099 During the present visit, LPA accompanied by staff conducted a tour of the physical plant and reviewed additional resident records. Interviews with the four currently admitted residents were also conducted or attempted. Regarding the allegation that Facility staff restricted resident from having visitors, the following has been concluded: A review of the facility's visit log conducted on February 3, 2025 confirmed that multiple family visits had occurred with resident R1 prior to their passing. A wide majority of witnesses interviewed denied any issues with visiting their relatives or loved ones at the facility, with or without giving advance notice to facility staff. Residents interviewed also stated that they could receive visitors in accordance to the facility house rules and visitation policy included in their respective admission agreements. As a result, the allegation is found to be Unsubstantiated, meaning that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred. On this day, Licensing Program Analyst (LPA) Kevin Saborit-Guasch made an unannounced visit to the facility for the purpose of conducting the Required Annual Inspection. LPA was greeted and granted entry by facility caregiving staff after introducing himself and stating the reason of the visit. Facility administrator Russell Venanzi was notified of the visit via telephone. Assistant administrator Tommy Tran arrived later to assist with the visit. Administrator Venanzi also assisted in person later. During the inspection, LPA and facility staff conducted a tour of the physical plant and observed the following: The facility is a two-story home with three private and one shared bedrooms in addition to the facility's common living areas. Second level is only for use by overnight staff. There are two bathrooms, one shared, one en-suite from the shared bedroom, both of which observed to be equipped with grab bars and slip mats. All resident bedrooms have the required furnishings. LPA observed all beds have linens and blankets. One bed is observed to be equipped with full rails for postural support as well as a variable pressure bed. This specific resident is confirmed to be receiving hospice care that was initiated on July 30, 2024. Plan of care provided and reviewed during the visit. There are currently five residents admitted to the facility, one of which is receiving hospice care. There are no bedridden residents admitted at the time of the visit. Bathrooms faucets and toilets are operational. Water temperature was verified to be within acceptable range. LPA observed emergency disaster plan with means of exiting and emergency phone numbers listed and posted. Fire and emergency drills have been conducted quarterly and documented. LPA observed the facility has a 2-day supply of perishables and a 7-day supply of non-perishable food. Smoke and carbon monoxide detectors tested operational. Fire extinguisher present is observed to be fully charged with up-to-date maintenance tag. There is adequately shaded outside space with outdoor furniture present. There is a self-latching gate on one side. The route of egress is free of obstructions. There are no bodies of water on the premises. The medication central storage was also observed to be secure and reviewed to be accurate and up to date with the resident's prescription orders. LPA reviewed five resident files and three staff files. Resident records include all necessary components. All staff members are confirmed to be cleared and associated with this particular licensed location. Current CPR training, training documentation and health screenings on file. Two resident and two staff interviews were conducted during the visit. Based on the observations made during today’s inspection, no deficiencies are being cited per Title 22 Division 6 of the California Code of Regulations. Three Technical Assistance advisory notes are provided with a consultation on the required Infection Control Plan, dimensions of the Residential Care Facility for the Elderly Complaint poster PUB 475 as well as the contact information list needed in the Emergency and Disaster Plan .
