Allegation investigated: Staff sleeping in common area during working hours Due to lack of supervision, resident eloped

Licensing Program Analysts (LPAs) Christi Coppo and Ethel Contreras arrived at this facility unannounced, to deliver findings into the above allegations. Adminstrator reached by phone. Caregiver signed report Complaint alleges staff sleeping in common area during working hours. Complainant states staff observed sleeping on the couch during the day shift while supposed to be working. During investigation, LPA conducted interviews. LPA did not receive any reports or observations of staff sleeping while on duty. LPA unable to confirm staff sleeping on couch while on duty. So, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED. Complaint alleges due to lack of supervision, resident eloped. Complainant states that on 5/28/25 continued to 9099AC... Unsubstantiated continued from 9099A... resident (R1) was allowed to elope. CCL defines elopement as having to meet 2 criteria: being outside of he facility and being unattended. During investigation, LPA reviewed R1’s physician report indicating R1 was ambulatory and had diagnosis of dementia. During investigation, LPA reviewed evidence indicating R1 had been outside in front of the facility for an extended period of time and that facility staff was having difficulty getting R1 to come back inside facility. Facility admits that R1 was often outside for extended periods of time. However, facility claims that a staff member always had watch over R1; so, R1 was never left unsupervised, despite R1’s refusals to come back inside the facility. Facility claims that R1 was never outside alone or unsupervised. So, due to conflicting accounts regarding the supervision of R1 while outside, and although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED. Allegation investigated: Staff showed residents on social media without resident consent.

On 01/15/2025, Licensing Program Analysts (LPAs) Julie Florio and Robert Frank arrived unannounced to deliver complaint investigation findings regarding the above allegation and met with Robert Christian Bayot, Licensee. Reporting Party (RP) alleges that an unnamed staff member showed residents on social media without resident consent. LPA Florio conducted 10-day complaint investigation visit on 10/22/2024 and obtained documents, made observations, and conducted interviews with Licensee, Staff 1 (S1), Resident 1 (R1), and Resident 2 (R2) who were each unable to confirm that any facility staff have ever showed residents on social media. LPA Florio conducted subsequent complaint investigation phone call interviews with Staff 2 (S2), Staff 3 (S3), Staff 4 (S4), and Staff 5 (S5) on 1/13/2025 where each stated they have never taken photos/videos of any of the residents in care or shared anything regarding residents on social media. Continued on LIC9099C... Unsubstantiated Continued from LIC9099... Additionally, each stated they have never seen or heard of any other staff taking photos/videos or posting anything regarding residents on social media either. As a result, LPA Florio received conflicting information regarding the above allegation. Based on record review, observations made, and interviews conducted, the allegation of staff showed residents on social media without resident consent is UNSUBSTANTIATED. A finding that the complaint allegation is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is UNSUBSTANTIATED. No Deficiencies cited during visit. Exit interview conducted. Type of visit: Required - 1 Year

At approximately 1:40 PM, Licensing Program Analyst (LPA) Stefanie Mutialu made an unannounced annual required inspection of this licensed senior care facility. LPA was greeted by Sallome Magon,caregiver. Administrator, Robert Bayot arrived shortly after. The facility is a single story home licensed for six (5) non-ambulatory residents and a hospice waiver capacity of five. The facility currently provides care for five residents. In addition, there are two residents on hospice. At approximately 1:55 PM, LPA and Administrator toured the building and grounds which was found to be clean and in good repair. All notices that are required to be posted have been posted. LPA advised Administrator CCL Annual Report (last 12 months) must be posted in highly visible area. Resident’s bedrooms, common areas, kitchen & food storage areas were inspected. There was a sufficient supply of both perishable and nonperishable foods as required by Title 22 Regulations. Toxins are stored in a locked cabinet in the hallway. Sharps and other kitchen supplies that could pose danger if available to residents were found secured in a lock box in a kitchen cabinet. There was a supply of cleaners, hygiene products and paper products available for residents. All resident’s bedrooms have lighting & appropriate furnishings. Water temperature measured within regulation between 114 and 115 degrees F at three of three faucets accessible to residents. One out of one fire extinguisher was inspected and charged. Six out of Six Combo Smoke/Carbon Monoxide detectors were present, inspected and found in working order. There was enough lighting in all common areas, resident rooms, and hallways. Medications located in designated cabinet were found to be secured. LPA conducted a spot check of medications and found all administering and records to be in order. Five of five residents were found in their room. Residents were observed resting in their rooms napping or watching television. LPA observed staff checking on residents and preparing food. At approximately 2:45 PM, LPA reviewed Five of five resident records which were all found to be well organized, thorough and contained the required documentation. At approximately 3:10 PM , LPA reviewed two out of two staff records which were all found to be well organized, thorough and contained the required documentation. Administrator Robert Bayot's Administrator Certification 7026826740 is current and expires on 11/05/2025.
