Licensing Program Analyst (LPA) Kelly Dulek conducted an unannounced subsequent complaint visit with the purpose of delivering findings for the above listed allegation. Upon arrival, LPA was greeted by front desk staff. LPA met with Executive Director (ED) Madison Lewis at 02:40PM. Entrance interview conducted. During an initial complaint visit conducted on 09/13/2024 from 09:30AM to 02:00PM, LPA Brian Balisi conducted physical plant tour, interviewed staff and reviewed and obtained pertinent documentation relevant to the investigation. Licensing Program Analyst (LPA) Brian Balisi conducted a subsequent complaint visit to investigate the allegations listed above. During today’s visit, LPA met with staff and explained the reason for the visit. Executive Director Madion Lewis arrived shortly after. On 02/15/2024, the Department received a complaint which alleged that an unknown individual in the facility drugged and raped Resident #1 (R1). The time frame of the abuse is unknown but is believed to have occurred in the recent past. It is believed that R1 has dementia. It was also reported that the police are in the process of interviewing R1, staff and other potential witnesses. LPA met with licensee Dan Zaharoni and explained the reason for the visit. Discussion held with Mr. Zaharoni regarding allegations above from approximately 9:45am-10:15am. During today's visit LPA conducted a physical plant tour and conducted random resident interviews from approximately 10:30am-12:00pm and 2:30pm-3pm; Staff interviews conducted from 12:15pm-1:45pm; Review of the pager response time record for 7 days conducted from 1:45pm-2:30p. Based on interviews conducted and a review of the pager response times, it was confirmed that, in several instances, staff response times are taking over ten (10) minutes to one (1) hour. Licensing Program Analyst (LPA) Teresa Camara conducted a complaint visit to the facility. LPA met with licensee Dan Zaharoni and explained the reason for the visit. On 12/2/2022, the management company for this facility changed. During the transition Briman Vivar (Vivar) has been the acting administrator. LPA confirmed that Vivar has a current administrator certification. Licensee acts as a back-up to the acting administrator. Licensee is in the process of obtaining his own adminsitrator certification and intends to name Vivar as the administrator/executive director of the facility. Licensee will submit all necessary documentation in order to make the change to Vivar as the administrator by 1/20/2023.
