Allegation investigated: Facility is in disrepair. Facility staff failed to properly administer resident’s medications.

Licensing Program Analyst (LPA) Fred Arias conducted an unannounced complaint visit to finalize an investigation into the above allegations. LPA was greeted and granted entry into the facility and explained the reason for the visit. It was alleged facility is in disrepair and facility staff failed to properly administer resident's medications. LPA conducted interviews with staff and residents. LPA reviewed records obtained. The investigation determined as follows: Regarding the allegation the facility is in disrepair, LPA toured the facility with staff to determine if the facility is clean, safe, sanitary and in good repair. At 11:01AM, LPA observed the cabinet lock under the kitchen sink was not operational. Cleaning agents such as bleach were found to be stored in the cabinet below the sink and acessible to residents in care. Interviews with four out of six residents stated the facility has remained in good repair overall. Interviews with three out of three staff stated there are two maintenace persons who are available to make repairs to the facility as needed. Substantiated Three out of three staff stated there is sufficient staff coverage and several back up staff is available when needed. LPA record review of the LIC500 indicates there are seven caregivers available or on call with at least two caregivers scheduled to work from 7AM to 7PM and one caregiver scheduled to work from 7PM to 7AM. LPA reviewed schedule indicating two staff during the day shift and one staff during the night shift from May to April 2026. Regarding the allegation facility failed to maintain a complete and accurate resident’s records, it was reported resident records were incomplete. Record review revealed six out of six resident files included the required documents including admission agreements, physician reports, TB testing, appraisals, personal rights, consent forms, ID form, centrally stored medication and destruction records, and safeguards for personal property/valuables. Regarding the allegation facility failed to maintain a complete and accurate staff records, it was reported staff records were incomplete. Record review revealed six out of six staff files included the required documents including health screenings, TB testing, background clearance, recent training including First Aid, and personnel applications. Based on interviews and record review, LPA is unable to corroborate the allegations. Therefore, the allegations are deemed to be UNFOUNDED, meaning that the allegations were false, could not have happened and/or is without a reasonable basis. An exit interview was conducted and a copy of the report was left with the facility. LPA observed a maintenance person arrive at the facility during the visit to repair the broken lock in the cabinet below the sink. LPA did not observe any other physical plant issues during the visit. Regarding the allegation the facility staff failed to properly administer resident’s medications, LPA reviewed medication administration. Interviews with four out of six residents stated they receive assistance with medication administration. Those four residents added medications are administered as prescribed. One out of three staff stated Administrator Jerry Filio is in charge of providing medications to residents. Record review for Resident 3 (R3) does not indicate on their medical assessment they can administered own injections. Interview with R3 stated they administer their own injections daily since moving into the facility. LPA audited medications for five other residents and did not find any additional discrepancies. Based on interviews conducted and record review, the preponderance of evidence standard has been met. Therefore, the above allegations are found to be SUBSTANTIATED. Type of visit: Required - 1 Year

On March 13, 2026, Licensing Program Analyst (LPA) Eboni Bentley conducted an unannounced required 1-Year annual visit using the CARE Inspection Tool. Upon arrival at the facility, LPA Bentley introduced self and was granted entry into the facility by staff, after stating the purpose of the visit. Administrator (AD) Jeremias Filio was present and assisted with today’s inspection. Jeremias Filio has an Administrator certificate that expires on March 10, 2028. The facility is licensed to operate for age range 60 and over for a capacity of six (6): one (1) Bedridden and five (5) non-ambulatory, with a Hospice waiver for six (6) residents. The building is a one-story home located in a residential neighborhood. It consists of the following: six (6) resident bedrooms, one (1) staff bedroom, four (4) bathrooms, living room area, kitchen, an attached two car garage, and outdoor seating area. During the visit, LPA toured the inside and outside of the physical plant with staff. There were no bodies of water or obstructions on the premises. All rooms were inspected, beds and bedding supplies were in good condition, and storage for each resident’s personal belongings was observed. Bed linens, comforters, and bath towels were adequately stocked at the time of visit. A comfortable temperature of 72 degrees F was maintained throughout the facility. Bathrooms were found to be clean and operational, with water temperatures in bathrooms measured between 114.4 degrees F and 116.7 degrees F. Continues on LIC 809-C .... The smoke detectors and carbon monoxide detectors were operable. First aid kit is maintained and contains all the necessary elements. Emergency safety drills were last conducted on January 5, 2026. The facility has two (2) fire extinguishers that were charged, mounted, and last serviced May 1, 2025. Current Liability Insurance was provided during the visit with a policy start date of April 25, 2025, through April 25, 2026. A working telephone (714)964-1402 remains available and the facility has a device that can be used for video teleconference purposes. LPA conducted an audit of six (6) resident files (R1-R6), three (3) staff files (S1-S3), and medication and medication administration review. Resident and staff interviews were conducted. Based on today’s observations, no deficiencies are being cited as per Title 22 California Code of Regulations, Division 6, Chapter 8. On September 24, 2025, at 9:15 AM, Licensing Program Analyst (LPA) Edward Kim conducted an unannounced required 1-Year annual visit using the CARE Inspection Tool. Upon arrival at the facility, LPA Kim met with Administrator (ADMIN) Jeremias Filio and explained the purpose of the visit. The facility is licensed to operate for five (5) nonambulatory residents of which one (1) may be bedridden and have a hospice waiver for six (6) residents. The facility is a single-story building located in a residential neighborhood. It consists of the following: six (6) resident bedrooms, one (1) staff bedroom, four (4) bathrooms, living area, dining area, kitchen, outdoor patio area, and an attached two car garage. LPA Kim toured inside and outside of the physical plant. There were no bodies of water or obstructions on the premises. All rooms were inspected. Beds and bedding supplies were in good condition, adequate lighting was provided, storage for each resident’s personal belongings was observed. Bed linens, comforters, and bath towels were adequately stocked at the time of visit. The Resident’s rooms were inspected: Resident Room 1, Resident Room 2, Resident Room 3, Resident Room 4, Resident Room 5, and Resident Room 6. Bathrooms were found to be within Title 22 regulations and were clean and operational. The water temperature measure 113.9 degrees F to 116.0 degrees F. A comfortable temperature of 79 degrees F was maintained in the facility. Evaluation Report Continues on LIC 809-C LPA Kim observed the facility to be sanitary and appropriately furnished at the time of visit. Storage areas for personal hygiene, cleaning supplies, toxins, and sharps objects were stored and not accessible to residents. The kitchen was inspected and there is a two-day supply of perishable and seven-day supply of non-perishable food available and maintained properly. Emergency food, emergency water, and emergency supplies were stored in the garage. During the visit, LPA Kim observed the facility's infection control practices, plan of operation, and screening protocols for visitors, staff, and residents. LPA observed the facility has a 30-day supply of Personal Protective Equipment (PPE). All mandated inspection control posters were posted. The PUB 475 poster posted next to the medication cabinet measured at 11”x 17”. The smoke detectors and carbon monoxide detectors were operable. A working telephone (714) 964-1402 remains available. First Aid kit had all the necessary elements. The facility has two (2) fire extinguishers that were charged, mounted in the dining area and next to resident room 1 that was serviced on May 1, 2025. Emergency drills are conducted quarterly. Evidence of Insurance is effective April 25, 2025, to April 25, 2026. LPA Kim conducted an audit of resident files (R1-R6), staff files (S1-S2), and medication and medication administration record that were all in order and complete. LPA Kim conducted interviews with one (1) staff and one (1) resident. A Technical violation was issued during the visit. LPA observed PUB475 measured at 11”x 17” instead of the regulated 20”x 26”. On today's date, Licensing Program Analyst (LPA) LPA Rosie Quiroz conducted an unannounced visit for the purpose of conducting a required Annual inspection. LPA was greeted and granted entry into the facility by Administrator (AD) Jeremias Filio. LPA met with (AD) Filio and discussed purpose of today's visit. This is a Residential Care Facility for the Elderly, licensed to provide services to age range 60 and over, approved for capacity of (6) residents; 1 bedridden and 5 non-ambulatory residents and has a Hospice waiver approved for 6 hospice residents. There are currently six (6) resident in care at this time, of which (1) one is receiving hospice care services. AD Jeremias Filio has an Administrator certificate with expiration date of March 10, 2024 indicating he completed the renewal February 26, 2024 and waiting to receive renewal certificate. AD Filio agreed to submit new certificate to CCLD upon receipt. LPA along with (AD) Filio toured the interior and exterior of the facility. During today's inspection tour, LPA observed 2 of 4 Residents in the living room with staff supervision and 4 of 6 residents in their bedrooms resting. LPA Quiroz interacted and interviewed with caregivers and residents during today's visit. LPA inspected resident's bedrooms and bathrooms. The water temperature in resident's bathrooms were recorded to be within normal limits. LPA inspected resident's bedrooms and appeared to be clean. Facility temperature in resident's bedrooms and throughout the facility was recorded to be 74 degrees Fahrenheit. LPA observed the emergency and disaster and evacuation plan. Fire extinguisher observed last serviced on March 2, 2024. LPA observed functional and operational washer and dryer in the garage area. Medications, sharps and disinfectants were observed to be locked and secured. LPA toured the outside of the facility and observed seating and shaded area in the backyard for residents and visitor's enjoyment. CONTINUED ON NEXT LIC 809-C PAGE... CONTINUED...On or about 3:35pm while inspecting the kitchen area, LPA Quiroz observed pineapple with fuzzy green in color on pineapple in container without a cover appearing to look like mold, unlabeled food in zip lock bags with no dates, multiple food items not labeled without covers and the following expired food with expiration dates ranging between February 3, 2023- March 3, 2024: ranch dressing, tartar sauce, lasagna, pears, apples, melon, activia yogurts and snack vanilla and chocolate puddings. AD Filio verified observations and discarded expired food during today’s visit indicating “Tomorrow is grocery day.” (SEE LIC 809-D) Facility has supply of emergency food, limited water and PPE in the garage area readily available for staff and residents in care. LPA verified that fire/disaster drills are conducted at least quarterly. The last fire drill was conducted on December 12, 2023. LPA reviewed 6 of 6 resident records and 6 of 7 personnel files. Citations issued during today's visit. During today's visit, LPA provided Consultation on Title 22 and Infection control. On or about 3:35pm while inspecting the kitchen area, LPA Quiroz observed multiple food items not labeled without covers and mutiple expired food items with expiration dates ranging between February 3, 2023- March 3, 2024.
