Licensing Program Analyst (LPA) Michael Tea conducted an unannounced visit. The purpose of today’s visit was to conduct the Annual Required inspection. LPA Tea was greeted and granted entry into the facility by caregiver staff and explained the reason for the visit. Administrators (AD) Dennis Bui and Kevin Dinh arrived shortly to assist with the visit. Facility is licensed for 6 non-ambulatory residents of which one may be bedridden in Room 3 only, with a hospice waiver for six. Currently there are four residents, two are on hospice during today's visit. LPA Tea reviewed four resident files and two staff files. Resident files and staff files contained all required documentation. AD Bui’s Administrator certificate expires on August 15, 2026. The facility’s last fire drill was conducted on January 15, 2026. LPA Tea along with the administrators toured the facility. LPA toured the physical plant, checked food service, and the first aid kit. The home is a two-story home that consists of three shared resident bedrooms, two full bathrooms, living room, dining room, kitchen and garage on the first floor. The second story is only for staff; no residents reside there. LPA observed smoke detectors/carbon monoxide in common areas and bedrooms are operational. Resident bedrooms had the required furniture, bed linens and closet/drawer space to accommodate each resident comfortably. Resident bathrooms were checked. Toilets and water faucets worked properly, grab bars were secure and shower was free of mold/mildew. Water temperature measured between 109.6 to 115.3 Fahrenheit degrees. Resident bath towels, toiletries and personal hygiene supplies were adequately stocked at time of visit. Common areas were clean and clear of hazards; doorways were free of obstructions. First aid kit had all the required elements including dressing, bandages, tweezers, thermometer, and scissors. Kitchen was inspected. Perishable and non-perishable food supply (Annual Inspection continuation on LIC809-C) was checked and adequately stocked at time of visit. LPA observed sharps locked in a kitchen drawer.LPA also observed toxin substances to be secured and locked and inaccessible to residents underneath the cabinet underneath the gas range. The fire extinguisher in the kitchen is fully charged. Kitchen appliances are operational during today's visit. LPA toured the outside grounds and there is ample seating with shade and the exit gates are self-latching and operational on both sides. There is a swimming pool that is secured and inaccessible to residents in care. LPA observed emergency food and water supply in the kitchen and garage. Facility provides activities based on their preferences and health condition. They walk around the facility and the neighborhood. The residents listen to music and watch movies. They also play games on the iPad. At the time of the visit, LPA observed residents relaxing in the living room and later enjoying delicious Vietnamese cuisine for lunch. LPA reviewed medication storage and administration. Medications are stored in a locked cabinet in the kitchen. Medications are being administered per physician order. LPA interviewed residents regarding their quality of care and spoke to staff present regarding care provided. Based on the observations made during today’s visit, no deficiencies were noted today in the areas inspected per Title 22 Division 6 of the California Code of Regulations. LPA Tea was greeted and granted entry into the facility by Administrator/Licensee Kevin Dinh. On this day LPA Tea amended LIC9099, LIC9099C and LIC9099D dated 09/18/2025. LPA reviewed amended report with Administrator. An exit interview was conducted with the administrator. Allegation investigated: - Staff is restraining a resident in care

On this day, Licensing Program Analyst (LPA) Michael Tea made an unannounced visit to conclude and deliver findings for a complaint investigation. LPA Tea was greeted and granted entry by facility staff and explained the reason for the visit. Administrator (AD) Kevin Dinh arrived shortly to assist with the visit. The Department received a complaint on June 6, 2025, and LPA Tea conducted the initial 10-day visit the following week on June 16, 2025. LPA Tea spoke to facility staff and residents and reviewed and collected pertinent documents and information. It was alleged staff is restraining a resident in care. The investigation determined the following: A photograph was provided to the Department of Resident 1 (R1) being restrained using a fabric material. It appears to be a bathrobe belt tied at each side of R1’s bed rails above their waist. The witness said they were shocked and (Complaint Investigation continued on LIC9099-C) **THIS IS AN AMENDED REPORT** Substantiated explained to the administrator that they could not do that to the resident even if the resident was a fall risk. The witness explained to the administrator that there were other ways to prevent falls and thought it was dangerous for them to put any kind of restraint on residents. They offered the facility a bed alarm but reminded them that they still need to keep a close eye on R1 especially since the resident was the only resident at the facility at the time. Per another witness LPA interviewed, the witness saw the restraint placed on R1 when they were sitting on the lazy boy chair in the living room. The witness said it was just briefly that R1 had a restraint. The witness said it was not a rope or anything of a hard restraint. The witness thought the restraint was a reminder to prevent R1 from falling. The witness felt the facility cared about R1. Per interview with Administrator Kevin Dinh, he admitted that a physical restraint was placed on R1 because he was a fall risk due to his health diagnosis and condition. He said they had placed the restraint around R1 but it was loose not tight at all. He said R1’s family was okay with it. He explained that the family thought it was a great idea with the restraint and appreciate it. At the time of initial visit, LPA observed the resident to have no physical restraints on them. The facility was provided a bed alarm for the resident by the hospice agency to detect any movements to prevent falls. A few days later after LPA's initial visit, R1 moved to another facility. Therefore, based on LPA Tea's observations and interview conducted, the allegation that staff is restraining a resident in care is determined to be SUBSTANTIATED, meaning the complaint allegation is valid and that a violation has occurred. He said there are no residents at the facility since they have been licensed for a year. LPA will attempt another visit at a later time and have administrator sign the report. Licensing Program Analyst (LPA) Michael Tea conducted an unannounced visit. The purpose of today’s visit was to conduct the Annual Required inspection. At around 1:10 PM, LPA Tea was greeted and granted entry into the facility by Administrator (AD) Dennis Bui and explained the reason for the visit. Administrator (AD) Kevin Dinh arrived shortly to assist during the visit. Facility is licensed for six non-ambulatory residents, with an approved hospice waiver for six, and one maybe bedridden in Room #3. Currently there are no residents in care during today's visit. The administrator hopes to have residents for the facility during this year once the facility is approved for the Assisted Living Waiver (ALW) program. LPA Tea along with the Administrator toured the facility at 1:20 PM. LPA toured the physical plant, checked the first aid kit. The facility is a two-story home that consists of three resident bedrooms that will be shared, two full bathrooms, living room, dining room, kitchen and garage on the first floor. The second story is only for staff, where there is a loft and bedroom and full bathroom, no residents will reside there. LPA observed smoke detectors/carbon monoxide in common areas and bedrooms to be operational. Door alerts were not working. Administrator will contact the alarm security company and have them fix it. Resident bedrooms had the required furniture, bed linens and closet/drawer space to accommodate each resident comfortably. Resident bathrooms were checked. Toilets worked properly and water faucets were a little bit loose. The grab bars were secure, and shower was free of mold/mildew. Water temperature measured around 112.2 Fahrenheit degrees. Resident bath towels, toiletries and personal hygiene supplies were adequately stocked at time of visit. Common areas were clean and clear of hazards, doorways were free of obstructions. First aid kit had all the required elements including dressing, bandages, tweezers, thermometer, and scissors. Kitchen was inspected. Kitchen appliances are operational during today's visit. Sharps are locked and stored in a secured drawer in the kitchen. LPA also observed toxin substances inaccessible to clients in care, locked and secured underneath the stove. The fire extinguisher is fully charged in the kitchen. LPA toured the outside grounds and there is ample seating with shade. There are two exit gates that are self-latching and operational on both sides of the house. The backyard has a pool that is gated. Continuation of the annual report on LIC809-C No resident files were reviewed, and interviews were not conducted as there are no residents living at the facility. There were no health and safety concerns observed during today's visit. Based on the observation made during today’s visit, no deficiencies were noted today in the areas inspected per Title 22 Division 6 of the California Code of Regulations. Type of visit: Prelicensing

Licensing Program Analyst (LPA) Dwayne Mason Jr. made an announced inspection to the facility for purpose of conducting a pre-licensing inspection. LPA arrived and was greeted and granted entry by Administrator Dennis Bui and Licensee Kevin Dinh. An application to operate a Residential Care Facility (RCFE) for (6) capacity, (0) ambulatory, (5) non-ambulatory, and (1) bedridden residents was received by Community Care Licensing (CCL) on 12/4/2023. The facility is the first floor of a two-story home. The second floor is not included in the facility's fire clearance and residents do not have access to the second floor. The facility houses three shared resident bedrooms, two bathrooms, living room, dining room, kitchen, detached two car garage and backyard with pool. LPA did not observe any obstructions blocking the exit gates or obstacles or hazards in the backyard. Client Bedrooms have all the necessary requirements including bed, chair, storage for clothing and ample lighting. LPA observed all windows were screened. All bathrooms have working plumbing and designated hand washing posters. Hot water heater is set to 115 degrees Fahrenheit. Pool: The facility has a pool in the backyard. The pool is enclosed on its two shorter sides by a brick wall. It's two longer sides are enclosed by a pool patio area and brick wall on one side and an iron fence on the side closer to the house. The iron fence is five feet high with four inches of space between each vertical bar and four inches of space between the bottom of the fence and the ground. The iron fence has a door that opens away from the pool. It is self-latching. LPA observed the fire extinguisher to be fully charged as indicated by the arrow pointing in the green zone. LPA observed a receipt for the fire extinguisher which indicates the it was purchased on 1/6/2024 LPA observed chemicals, cleaning solutions, laundry toxins and disinfectants are inaccessible to residents and are stored and locked in the kitchen and garage. Medications, First-Aid Kit, Resident & Staff Files will be locked in cabinets in the kitchen and hallway. The fire clearance was approved by a fire inspector of Orange County Fire Authority on 1/11/2024. A supply of extra linens is stored in the closet under the stairs. Emergency Phone Numbers, Exit Plan, PUB475 are all posted and available for review. Smoke and Carbon Monoxide detectors are stationed throughout the home and are wired together. Both types of detectors were tested and noted as operational. Operational appliances include a gas stove, oven, refrigerator, dishwasher, microwave, washing machine and dryer. LPA reviewed and provided Licensee with the Component III presentation to offer information and resources regarding maintaining facility compliance. The designated AD was notified that the final application approval will be issued by the Centralized Applications Bureau in Sacramento.
