Allegation investigated: Staff handles resident in a rough manner

On 08/20/2026 LIcensing Program Analyst (LPA) Renese Howell-Small arrived unannounced to the facility in order to deliver findings for the above allegation. LPA observed one (1) resident in care and one (1) resident was out of the facility. The allegation that staff handles resident in a rough manner: LPA interviewed two (2) residents and two (2) staff. Staff denied the allegation and stated that they assist the residents with what they need. Resident 1 (R1) is able to express their needs and communicate. R1 stated that they are treated well by staff. Resident 2 (R2) stated that staff take good care of the residents. LPA reviewed staff records which revealed that certifications and trainings were current. LPA reviewed the required documents for R1 and found the files to be complete. Based on interview and record review, this allegation is UNSUBSTANTIATED. Unsubstantiated UNSUBSTANTIATED is defined as the allegation may have happened or is valid, but there is not a preponderance of the evidence to prove that the alleged violation occurred. Licensing Program Analyst (LPA) Renese Howell-Small made an unannounced visit to the facility. The purpose of the visit was to conduct a required comprehensive annual inspection. LPA met with Licensee Miriam Nauseda and was granted entry to the facility. Licensed capacity is (6) current census (3). LPA was accompanied by Licensee Miriam Nauseda and Eric Gad to conduct a general overall inspection, which included, but was not limited to, the following: Physical Plant: The facility is operating in the capacity approved by Community Care Licensing (CCL). There are no obstructions to indoor and outdoor passageways. The facility is maintained at a comfortable temperature. LPA inspected resident bedrooms; they are equipped with required furniture such as: mattresses, night stands, storage space, and sufficient lighting; bathrooms were clean, and appliances were operating appropriately. LPA observed sufficient furniture and lighting throughout the facility. The facility is equipped with operating smoke detectors and carbon monoxide alarms. Posters such as personal rights, the CCL complaint poster, and the disaster plan were posted in a common area. Cleaning supplies, toxins, sharps, and other dangerous items were kept inaccessible to residents in care. There was a designated office for resident/staff files. Overall, the facility is clean, in good repair, and operating in safe conditions for residents in care. Food Service: Non-perishable and perishable food supply is sufficient for number of residents in care. Facility has a variety of food available for residents. Dishes, cups, and utensils were also stored properly. Care & Supervision: Facility has sufficient care staff for coverage 24 hours a day, 7 days a week. Record Review: LPA reviewed three (3) resident files for admission agreements, updated physician reports, pre-placement appraisals and needs and services plans. LPA reviewed (3) resident medications and hospice files. LPA observed Resident 2 (R2), Resident #2 (R2) did not have a signed Admission Agreement. A deficiency will be issued. LPA also reviewed two (2) staff files for First Aid/CPR certification, criminal record clearance, training's, and health screenings. No issues were observed. Based on the observations made during today’s visit, one deficiency was cited per Title 22, Division 6, of the California Code of Regulations. Licensing Program Analyst (LPA) Anna Bueno & Bianca Wolcott arrived unannounced to conduct an annual inspection. Upon arrival LPA was greeted by facility staff Miriam Nauseda and granted entry. LPA began inspection with introduction, visit purpose. Physical Plant and Safety of Environment/Operational Requirements- LPA toured the facility inside and outside. LPA observed fence in pool area with an unlocked gate. This poses a immediate health a safety risk to residents in care. LPAs notified staff Miriam Nauseda who immediately locked the pool gate. LPAs observed the facility to be clean and in good repair. The home is maintained at a comfortable temperature for the residents. Lighting is sufficient for safety and comfort. Water temperature measured 107-114 degrees F. Laundry facilities and a locked cabinet is present for storing laundry soap and other chemicals under the sink. Fire extinguishers are charged, mounted and dated . All outdoor and indoor passageways are free of obstruction. A locked area is provided for medications and sharp objects. There is a telephone working at this location. The LIC 610E, emergency disaster plan is maintained. The facility has a current written definitive plan of operation. The facility is maintained in conformity with the regulations adopted by the state fire marshal. Personnel Records/Training/and Staffing-. LPA reviewed employee record for first aid certification, fingerprint clearance, personnel/job application, health screening and TB test results, criminal record statement, employee rights, training verification, and current administrator certification. Resident Records/Incident Reports/Personal Rights/Residents with Special Needs/Incidental Medical and Dental- LPA reviewed resident records. Three (4) records were reviewed. LPA reviewed for admission agreement, medical assessment and TB test results, consent forms, identification and emergency information, appraisal needs and service plans, centrally stored medication/destruction records, safeguard for personal property/valuables, and personal rights notification. The facility is meeting documentation requirements. Resident Rights are posted in the facility and a copy is signed on file. During the visit administrator Enrico Gad provided updated physicians reports for (3) residents. Resident Rights are posted in the facility and a copy is signed on file. Food Service- LPAs were present during the lunch time meal. The meal is adequate to meet the nutritional needs of the residents. Food prep areas are clean and organized. Food supply meets the requirement of one week supply of nonperishable and 2-day supply of perishables food on hand. LPA made observation throughout the inspection process to assess if the facility remains in conformity with the State Fire Marshall regulations. The facility has not exceeded its capacity limitation and the structure remains unchanged according to the approved floor plan. Smoke detectors and carbon monoxide detectors were tested and found to be operational. While reviewing medication and medication records, LPAs observed over the counter medications listed on the centralized medicine list.. This poses a potential health and safety risk to residents in care. Two client interviews were conducted. One staff interview was conducted. Based on the information received during this visit today, the following deficiency is being cited per Title 22, Division 6 of The California Code of Regulations. This report was reviewed with and a copy provided to the facility representative.
