Licensing Program Analyst (LPA) Tihesha Smith conducted an unannounced case management visit at this facility at 9:45 am. LPA Smith was greeted by staff and disclosed the purpose of the visit. The purpose of the purpose of today’s visit is to verify excluded employees are no longer working at the facility. LPA Smith conducted a walk through and did not observe staff #1 (S1) or staff #2 in the facility. House manager revealed the staff do not work here. No health or safety hazards observed during visit. Licensing Program Analyst (LPA), Tihesha Smith conducted an unannounced Required 1-year inspection at this facility at approximately 9:35 am. LPA Smith was greeted by staff and disclosed the purpose of the visit. Staff contacted the administrator. LPA Smith spoke with the administrator and disclosed the purpose of the visit. Administrator revealed spouse who is also an administrator will arrive shortly. LPA conducted a tour of the physical plant at approximately 10:20 am to ensure there are no health and safety hazards, and the facility follows Title 22 Regulations. Common areas were observed for the ability to safely serve the needs of residents. These included the kitchen, dining room area and living room. The common areas were checked for cleanliness and furniture was checked for functionality. Common areas observed to be furnished appropriately. LPA reviewed the food service areas, food storage and supply (perishable and nonperishable foods). The kitchen food supply was observed and sufficient for the five (5) residents currently residing there. Two (2) days of perishable and seven (7) days of nonperishable food observed. The freezer is stocked with frozen foods. The residents’ medications are locked in cabinet in the kitchen and observed to be locked and inaccessible to residents. Sharps are locked in kitchen island drawer observed to be locked and inaccessible to residents. The stocked first aid kit is stored above the medication cabinet in the kitchen. There are five (5) fire extinguishers: One (1) attached to the wall in the kitchen and four (4) in laundry room with one (1) attached to the wall. Fire extinguishers observed to be charged. The laundry room is located at the end of the first hallway by enclosed patio. The appliances observed to be (cont from 809) in good repair. Toxins stored in cabinet in laundry and under kitchen sink. Toxins observed to be locked and inaccessible to residents. The facility has a total of six (6) bedrooms and three (3) bathrooms and half bathroom. There are four (4) private bedrooms with (1) shared for residents and one (1) bedroom for staff. The residents’ bedrooms were properly furnished with at least one chair, nightstand, and sufficient lighting for each resident. The bedrooms had appropriate and adequate bedding and linens such as sheets, pillowcases, mattress pads, and blankets. LPA observed a supply of linens hall closet near bathroom. The bathrooms have the following items available: hand soap, paper towels, and trash cans. The hot water temperature was measured for the bathrooms to ensure it is within the required range for residents’ comfort and safety. The water temperature range measured:109.5- 118.7 degrees Fahrenheit. Backyard has the following: Covered enclosed patio with Two (2) Patio tables observed to have adequate seating. Patio furniture was observed to be in good repair. One (1) umbrella with table and one (1) umbrella stored in garage. Garage: Used to store PPEs, 2nd refrigerator food overflow and equipment. Pool gated and locked. Carbon monoxide detector/ Smoke detectors were tested and operable at the time of visit. Facility grounds were free of hazards. There were no immediate health and safety hazards observed during the day of inspection. At approximately 11:55 am, LPA Smith reviewed (6) residents and four (4) staff files. Resident files included but not limited to: Admission agreements, Physicians reports, Preadmission appraisals and consent forms. Staff records reviewed had the appropriate personal records such as: Clearances, Dementia trainings First aid/CPR. Dementia Care Plan name correction to be sent to LPA. No deficiencies cited. This Informal Conference was held at the Woodland Hills South Regional Office to discuss issues and concerns involving the Licensee/Administrator. Attendees present at the meeting are: Licensee/Administrator, Michelle Weisman Staff, Janeth Alfaro Licensing Program Manager, Naira Margaryan Licensing Program Manager, Nichelle Gillyard Licensing Program Analyst Angela, Panushkina Licensing Program Analyst, Huma Rahimi LPMs Naira Margaryan and Nichele Gillyard informed Mrs. Weisman that the purpose of the informal meeting was to discuss a complaint (control # 31-AS-20240923114331) received by the Regional Office on 09-23-2024, alleging Unlicensed Care to 4 individual who at one point lived at 5712 Tampa Ave. Tarzana 91356. On 10-03-2024, LPAs Panushkina and Rahimi initiated the complaint investigation. While touring the home, LPAs interviewed the Unlicensed Operator, Michelle Weisman, one (1) staff and attempted to interview two (2) residents present. LPAs left and conducted collateral visit to visit to The Nest facility # 197608595 to interview two (2) residents and staff previously observed at the Unlicensed location. LPAs also obtained copies of pertinent documents relevant to the complaint investigation. Continue on LIC9099-C Based on the information gathered it was determined that four (4) residents were being provided elements of care and supervision which include significant assistance with ADLs (i.e. dressing, bathing, toileting, incontinent care) and assistance with medications management. During the investigation of an Unlicensed complaint it was discovered that the Operator is the Administrator/Licensee of The Nest - a licensed facility (#197608595). Base on overall investigation, the complaint deemed to be Substantiated. A copy of the report, deficiency, and Notice of Violation of the Law (NOVL) will be issued at conclusion of this meeting. LPM Margaryan discussed the complaint and that moving forward no operation of an Unlicensed home is allowed while running a licensed facility. Any violation of Title 22 Regulation may result other adverse actions as it deemed necessary by the Department. Mrs. Weisman stated the following: I only had my family members that I took care of. Currently, there are no residents living at Unlicensed location. LPM Margaryan informed Mrs. Weisman a Certified RCFE (Residential Care facility for the Elderly) Administrator with CCL (Community Care Licensing) that she must immediately discontinue the unlicensed operation. Continuation of Unlicensed operation may impact Ms. Weisman’s Administrators certificate. During this meeting, Administrator Qualifications and Duties were discussed and the Licensee/Administrator was informed that at this time Ms. Weisman is in noncompliance with Title 22 Regulations Section 87405- Administrator Qualifications and Duties Therefore, at the time of this meeting the citation was issued under Title 22 Regulation, Division 6 Chapter 8. At 10:40 AM, Licensing Program Analysts (LPAs) Huma Rahimi and Angela Panushkina conducted unannounced collateral visit to the facility in conjunction with a complaint control #31-AS-20240923114331.LPAs met with the staff and disclosed the reason for the visit. The purpose of this collateral visit is to conduct an interview with two (2) residents and staffs for an open complaint investigation (complaint #31-AS-20240923114331). LPAs also obtained copies of pertinent documents relevant to the complaint investigation. Type of visit: Required - 1 Year

Licensing Program Analyst (LPA) Abeye Duguma met with Michelle Weisman for a Required One (01) Year visit. LPA explained the reason for the visit. A tour of the physical plant was conducted at around 2:00 PM and the following was noted: There is one entrance being utilized at the facility. The facility has a total of five (05) bedrooms for residents and four (04) bathrooms. The facility is fire cleared for six (06) non-ambulatory of which one (01) may be bedridden and a hospice waiver for four (04). The facility is currently occupying four (04) residents. The facility has outdoor furniture with a covered shaded area for residents and visitors. The facility has a swimming pool with appropriate fencing. The garage is currently being used for storage. Laundry detergents, cleaning agents and other toxins are locked away. Kitchen is sufficiently stocked with at least two (02) days perishable and seven (07) days non-perishable food. Frozen foods are wrapped and stored appropriately. Food storage and preparation areas are clean and inaccessible to pests. Knives and sharps are observed to be locked and inaccessible to residents. The living and dining room are neat and clean. The facility maintains a comfortable temperature at 76°F. The smoke and carbon monoxide detectors are hardwired, interconnected and observed to be operational. Fire extinguisher is located near the kitchen, observed to be fully charged and last purchased on 06/05/2024. (continued on LIC 809-C) The residents' rooms are adequately furnished with appropriate lighting system. Hallways are well lit. Residents have enough personal hygiene product provided by the licensee. The bathroom was checked for cleanliness and proper operations. The hot water temperature was measured at 113.6°F. Towels and washcloths are not shared. There was enough clean linen available in the cabinets. LPA observed medication and first aid kit to be locked and inaccessible to residents.
