On today's date Licensing Program Analyst (LPA) William Vanegas made an unannounced visit for the purposes of conducting an annual inspection. Upon arrival LPA was greeted and granted entry to the facility by care giving staff. Administrator (AD) Alexander Arias was notified via telephone and arrived shortly after in order to assist with the annual inspection. LPA began a tour of the facility and observed the following. AD has a valid Administrator Certificate valid from April 20, 2026 through April 19, 2028. The facility is a one storied home equipped with four bedrooms, two bathrooms, and a one car detached garage. LPA observed kitchen area to be clean and free of any mildew or debris. LPA observed the kitchen area to have a refrigerator, microwave, and a gas stove. All appliances appeared to be in good repair and tested operational. LPA observed a two day supply of perishable food and a seven day supply of non-perishable food, and a sufficient amount of emergency water. LPA observed all resident rooms to be free of any hazards, and any obstructions along the entrance ways. LPA observed all resident rooms to be large enough to walk about freely, and to have all required furnishings including: A bed, clean linens in good repair; meaning no strains or tears, a chest of drawers, a reading lamp, a chair, and enough storage space to store personal belongings. LPA observed all restrooms to be clean and free of any mildew and debris. LPA observed all water faucets, and toilets to be operational. LPA observed bathrooms to have all required furnishings including: Grab bars, slip resistant floor matts, and a shower chair as needed. Hot water temperature tested between 109.2 and 111.3 degrees Fahrenheit. CONTINUED ON LIC809-C LPA observed all fire extinguisher's to be fully charged and have an updated service tag. LPA observed all smoke detectors and carbon monoxide detectors to be in good repair, and tested operational. LPA observed first aid kit to be fully equipped with all required items including: scissors, tweezers, adhesive tape, bandages, a thermometer, and a first aid manual. LPA conducted a tour of the exterior of the facility and observed the following. LPA observed no obstructions and no hazards to be accessible to residents in care. LPA observed the backyard to be large enough to participated in outdoor activities upon resident request. LPA observed an outdoor shaded sitting area. LPA observed side exits to be free of any obstructions. LPA observed side gates to be self latching and unlocked. LPA reviewed five resident files, and two staff files. All files (Staff and Resident) had all required items. Staff annual training is up to date and documented correctly. Upon LPA document review two of five residents were considered bedridden and the facility license is not approved for any bedridden residents. Based on this review a deficiency will be issued and an immediate $500 civil penalty was issued. LPA reviewed medications with AD and observed all medications to be documented correctly. Per LPA review all medications are being administered per physicians orders. Based on observations made during today's inspection deficiencies will be issued per title 22 chapter 6 division 8 of the California Code of Regulations. Allegation investigated: - Staff handled resident in a rough manner

On this day, Licensing Program Analyst (LPA) Michael Tea made an unannounced visit to conclude and deliver findings for a complaint investigation. LPA Tea was greeted and granted entry by facility staff and explained the reason for the visit. Administrator (AD) Alexander Arias was not present at the facility but was able to assist from the phone. The Department received a complaint on December 20, 2024. During the investigation, Licensing Program Analyst (LPA) Tea interviewed facility staff, residents and witnesses, and reviewed facility records and other pertinent information. The department received a report that Resident 1 (R1) was handled in a rough manner by staff. During the investigation, a witness stated they heard R1 say they were abused. However, the witness also stated they never saw any abuse and had no proof that it occurred. It was also reported that R1 later took back (Complaint Investigation continued on LIC9099) Unsubstantiated their statement and said they were handled in a rough manner. LPA Tea interviewed Administrator Alexander Arias, who shared that R1 had dementia, was on hospice care, and their health was declining. The Administrator explained that R1 often had mood swings, became irritable, and had emotional outbursts toward staff. LPA also interviewed another resident who recalled that R1 would become very emotional when they did not get what they wanted. The resident described R1 as being incapacitated. During the investigation, LPAs interviewed a total of six residents. Five out of six residents stated they have never been abused and have never seen staff handle residents in a rough manner. These residents also shared that they feel safe living at the facility and are satisfied with the care they receive. One resident mentioned that a resident had difficulty adjusting to the facility due to it being a new environment. LPAs also interviewed four staff members. All staff denied the allegation and stated they do not handle residents roughly. Staff shared that they treat residents with care and respect, like family. They stated they assist residents gently, ask for permission before providing care, and check for any pain or discomfort. A review of staff records confirmed that all staff completed required initial and annual training, including training on elder abuse. Training materials reviewed also included information on preventing and recognizing abuse. Based on interviews, record reviews, and lack of evidence, there is not enough information to prove that staff handled R1 in a rough manner. Therefore, the allegation is UNSUBSTANTIATED meaning that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred. No deficiencies cited at this time and an exit interview was conducted with the facility. LPA Vanegas observed a refrigerator, microwave, dishwasher, gas stove, washer, and dryer. All appliances appeared to be in good repair, and tested to be operational. LPA Vanegas observed a two day supply of perishable food, and a seven day supply of non-perishable food, along with a sufficient amount of emergency water. LPA Vanegas observed all resident rooms to be clean and free of any debris. LPA Vanegas observed the bedrooms to have all required furnishings such as a bed, clean linens in good repair; meaning no strains or tares, chest drawer, a reading lamp, and enough storage space to store personal belongings. LPA Vanegas observed resident bathrooms to have all required furnishings such as grab bars, shower chair, and slip resistant floor matts. LPA Vanegas observed bathroom water faucets and toilets to be operational, and in good repair. Water tested between 119.8 and 125.3 degrees. LPA Vanegas observed all fire extinguishers to be fully charged and up to date. LPA Vanegas observed all smoke detectors and carbon monoxide detectors to be in good repair and operational. LPA Vanegas observed the backyard to be big enough to participate in outdoor activities upon resident request. LPA Vanegas observed there to be an outdoor shadded sitting area, and no obstructions along the exit routes. LPA Vanegas observed side doors to be self latching and unlocked. LPA Vanegas reviewed four resident files, and four staff files. All files (Staff and Resident) had all required documents and annual training was completed for all staff. LPA Vanegas reviewed medication administration record (MAR), and resident medications. Per LPA review all medications are being documented correctly and administered per physicians orders. Based on observations made during today's inspection no deficiencies will be cited per title 22 chapter 8 division 6 of the California Code of Regulations. LPA Lyman toured the facility at 7:20 AM and observed the following: Water temperature measured between 105.2 and 109.4 degrees F. Facility has a phone available for residents. LPA observed night light in hallway. Fireplace has a screen. Facility has ample emergency water. The "Let Us No" poster is posted in regulation size. Room 4 has been reconfigured and has 2 dressers for resident's belongings. Facility is ready to be licensed. Licensing Program Analyst (LPA) Kimberly Lyman made an announced visit to conduct a pre-licensing inspection. LPA identified herself and discussed the purpose of the visit with Administrator/ Licensee Alexander Arias. An initial application to operate a Residential Care Facility for the Elderly was received by CCL on 01/23/2024 for a capacity of six non-ambulatory residents. Facility has a screening area in the entrance of the facility. LPA Lyman along with Licensee/ Administrator toured the facility at 9:07 AM and observed the following: Structure: Facility is a one story, 4 bedroom, 2 bathroom house with a bonus room and an unattached garage and a tan exterior. The exit gates are closed, self latching, alarmed and unlocked. Living Room/ Dining Room: Adequate seating is available in the dining room and living room. Bedrooms Residents: Rooms will be single and double occupancy. All rooms are equipped with appropriate lighting, chair, night stand and ample closet space. Bathrooms: All resident bathrooms have a working toilet/ wash basin as well as grab bars and non-skid surface in the shower. Facility has sanitizer and paper towels in the restrooms. Linens & Hygiene Supplies: Facility has ample bedding and towels for residents in care. Emergency Phone Numbers and Exit Plan: Posted in the entrance of the facility. Food Service: Facility has 2 day perishables as well as 7 day non-perishables. Smoke Detectors: Smoke detectors/ carbon monoxide detectors are centrally wired and were tested operational. Fire extinguisher is mounted and charged. Appliances: Stove, oven, refrigerator, microwave, washer, and dryer are clean and operational. Toxins/ Sharps: Facility has multiple secured areas for toxins and sharps. Water Temperature: Tested and recorded between 126.6 and 137.2 degrees F. in facility bathrooms. Emergency Supplies: LPA observed ample emergency food as well as a posted emergency disaster plan. Medications, First-Aid Kit & Book: First aid kit observed contained all required items. Medication is stored and locked in a locked cabinet. CONTINUED ON LIC 809C DATED 06/13/2024 Facility to use use a medication administration record. Resident & Staff File: Records are stored in a secured file cabinet in the kitchen. Reading Material, Games, and Equipment: LPA observed activities such as games and reading supplies. Facility provides exercise and music therapy..Backyard: LPA observed a clean backyard with ample shaded seating for residents. Fire Clearance: Approved for six non-ambulatory residents on 04/12/2024. During the visit, LPA observed the following: Facility does not have fireplace screened. Please obtain a screen. There is not a working telephone on site. Please ensure there is a telephone. Facility does not have night lights in hallway. Please ensure night-lights are installed. Water temperature is out of compliance. Please adjust. Facility does not have ample emergency water. Please obtain additional water. Please post the "Let Us No" poster size 20" X 26" Please reconfigure bedroom 4 to ensure no doors are blocked and all required furnishings fit. Please obtain dressers for Component III conducted during the visit. Facility is not ready to be licensed. Licensee to contact LPA when corrections have been made.
