Licensing Program Analyst (LPA) Michael Cava conducted a complaint visit to the facility to investigate the above allegation. LPA met with staff, Wendy Rivera and the administrator, Jim Durando, and advised them of the complaint. Today’s investigation consisted of interviews with staff and residents. A physical plant inspection was also made to insure the health and safety of the residents. In regards to the allegation, it was reported by an another agency, that works in conjunction with the Department, and is also a credible source, that on or around 07/31/24, the inside of the facility was warm. The temperature inside the home was at approximately 89 degrees. Exterior temperature, or the weather, outside of the facility, on or around 07/31/24 was at least 100 degrees. Air conditioning was not broken, but staff did not know the combination to the lockbox covering the thermostat to adjust the temperature. At 11:10am Licensing Program Analyst (LPA) Angela Panushkina conducted an unannounced complaint visit to investigate the allegation above. LPA was greeted by Staff #1 (S1), who granted access to the facility. Upon arrival LPA was screened and LPA observed S1 wearing a mask. Administrator arrived shortly after and LPA explained the reason for the visit. Interviews with the Administrator confirmed that sometime, around 07/14/22 & 12/21/22, a random visits were made by a credible witness who observed facility staff were not wearing masks. Administrator admitted that a verbal conversation with the credible witness took place on January 23rd, 2023 and a staff meeting regarding COVID protocols were held on 01/24/2023. Licensing Program Analyst (LPA) Angelica Arambulo conducted an unannounced subsequent visit to deliver the findings on the above allegations. It is alleged that residents/clients at the facility are being verbally abused. LPA interviewed staff and clients at the home. All staff stated that have not witnessed anyone verbally yelling at clients or intimidating them. The clients interviewed were able to speak on their behalf and claimed they have not had any staff yell at them. Based on the information received during the interviews there is no reason to confirm that clients are verbally abused. The allegation is therefore, Unsubstantiated. It is alleged that Residents are being physically abused. LPA conducted interviews with several clients in the home. All clients stated they have not been abused nor have they witness any client being abused. The allegation is Unsubstantiated at this time.
