Licensing Program Analyst (LPA) Rebecca Borunda conducted an unannounced Required 1-Year visit. The facility file was reviewed prior to the visit. LPA was greeted by, identified herself to, and explained the purpose of the visit with Licensee Rigoberto Garcia. The facility has a licensed capacity of 6 residents, 5 may be non-ambulatory and has a pending hospice waiver increase for 6 residents. During today’s visit, the facility had a census of 6 residents, 2 ambulatory, 4 non-ambulatory, and 3 were receiving hospice services. The Administrator for the facility is Rigoberto Garcia and their certificate was valid and current. During today’s visit, LPA inspected each room of the facility, including resident and staff rooms, shared and common bathrooms, kitchen, garage, common areas, and outside space. No bodies of water, delayed egress, or secured perimeter were observed on the premises. The facility was found to be clean, safe, and in good repair with no pathway obstructions. LPA observed linens and hygiene products for resident use. The facility’s ambient and water temperature were measured within regulatory requirements at multiple locations. LPA observed locked storage for resident medications and hazardous and/or toxic chemicals, both of which were stored separately from food supplies. According to Rigoberto Garcia, no firearms or weapons are stored on the premises. LPA observed a minimum supply of 2-days of perishable food and 7-days of non-perishable food. The refrigerator and freezer temperatures were kept within requirements. Staff present at the facility had a criminal background clearance and association. LPA reviewed multiple resident and staff records. A LIC9102TV Technical Violation regarding annual visits with medical professionals was provided. No deficiencies were cited on today’s date. LPAs were greeted by, identified themselves to, and explained the purpose of the visit with Licensee Rigoberto Garcia. The facility is licensed for a maximum capacity of 6 residents, 5 of which may be non-ambulatory. The facility has a pending hospice waiver increase for 6 residents. During today’s visit, the facility had a census of 6 residents, 2 ambulatory, 4 non-ambulatory. 3 residents were receiving hospice services. The Administrator for the facility is Rigoberto Garcia and their certificate was valid and current. During today’s visit, LPAs toured the facility and inspected each room of the facility, including resident and staff rooms, bathrooms for resident and staff use, kitchen, garage, common areas, and outside space. No bodies of water were observed on the premises. LPA did not observe any aspects of delayed egress or secured perimeter. The facility was found to be clean, safe, and in good repair with no pathway obstructions. The facility’s water temperature was measured at 115.9 degrees Fahrenheit in a common bathroom and 112.6 and 106.2 degrees Fahrenheit in private bathrooms. The facility’s internal temperature was measured at 71 degrees Fahrenheit. LPAs observed locked storage for all hazardous and/or toxic chemicals and were stored separately from food supplies. According to Rigoberto Garcia, no firearms or weapons are stored on the premises. LPAs also observed locked storage for resident medications and resident and staff files. LPA observed a minimum of a 2-day supply of perishable food and a 7-day supply of non-perishable food present at the facility. The facility refrigerator was kept at 30 degrees Fahrenheit, and the facility freezer was kept at X degrees Fahrenheit. LPA observed linens and hygiene products provided to the residents that are in good repair and sufficient to meet their needs. Staff present at the facility during the time of the inspection had a criminal background clearance, were associated to the facility, and had a first aid certificate. Each resident record was complete and contained a signed admission agreement, initial physician’s report and medical assessment, documents regarding safeguarding personal property, and personal rights. Each staff file was complete and contained a personnel record, first aid certificate, fingerprint clearance and association, and a health screening. LPAs spoke with staff and residents present at the facility during the time of the inspection. The Licensee will submit copies of the LIC500 Personnel Report, LIC610E Disaster Plan, and current liability insurance to the Department within 15 business days. LPAs provided Licensee with an LIC9102TV Technical Violation regarding medication storage and an LIC9102TV regarding medication labels. LPAs also provided verbal guidance regarding the updated dementia regulations that became effective 1/1/2025. No deficiencies were cited on today’s date. Assistant Program Administrator (APA) Icela Estrada, Licensing Program Manager (LPM) Jennifer Lott, and Licensing Program Analyst (LPA) Rebecca Ruiz conducted an Office Meeting and met with Licensee Rigoberto Garcia to discuss the Department's inspection authority. During today's meeting, APA Estrada and Mr. Garcia discussed the Department's inspection authority regarding the facility records and admission agreements. APA Estrada reviewed regulations 87208 Plan of Operations and 87506(d), as well as Health and Safety Code 1569.269(a)(3) and provided Mr. Garcia with copies of the regulations and Health and Safety Code. APA Estrada advised that during future licensing visits, LPAs will remove facility records from the facility for review purposes to prevent resident distress. APA Estrada discussed referring Mr. Garcia to County of San Diego Mental Health for collaboration. APA Estrada advised that the Plan of Operation which includes the Admission Agreement needs to be updated and approved by the Department. This report was discussed with Mr. Garcia. Licensing Program Analyst (LPA) Rebecca Ruiz conducted a plan of correction visit. LPA was greeted by, identified herself to, and explained the purpose of the visit to Licensee Rigoberto Garcia. The purpose of the visit was to verify if the deficiency 87506(d) issued on 1/26/2024 regarding the Department's authority to review resident records had been corrected. On 1/26/2024, the licensee was issued a deficiency with a correction due date of 2/9/2024. During today’s visit, LPA Ruiz was unable to verify that the licensee corrected the deficiency regarding the Department's authority to review resident records prior to today's visit. The Licensee confirmed that he had not submitted a written letter stating that he had read and understood regulation 87506. Therefore, the deficiency 87506(d) has not been corrected by the POC due date. An immediate civil penalty of $100 per day for a total of $1,200 has been assessed on an LIC421FC for failure to correct. LPA provided guidance regarding appeal rights for civil penalties. . During today's visit, LPA Ruiz granted Licensee a POC extension for deficiency 87705(c)(5) with a new POC due date of 3/8/2024 on an LIC178. LPA Ruiz also observed Licensee review regulation 87506 and Licensee provided LPA with a written letter confirming that the Licensee read and understood regulation 87506. Therefore, the deficiency is cleared. An exit interview was conducted with Licensee Rigoberto Garcia. Licensee Rigoberto Garcia refused to sign the LIC421FC and the LIC809. Allegation investigated: Lack of supervision resulting in sexual abuse

Licensing Program Analyst (LPA) Rebecca Ruiz conducted an unannounced complaint visit to deliver findings regarding the above-mentioned allegation. LPA identified herself to, was greeted by, and explained the purpose of the visit to Licensee Rigoberto Garcia. The Department’s investigation consisted of interviews with residents, staff, and outside sources, records review, and a tour of the facility. It was alleged that lack of supervision resulted in the sexual abuse of Resident 1 (R1), specifically that Resident 2 (R2) had engaged in sexual misconduct with R1. Interviews with staff and review of R1’s and R2’s physician reports revealed that R1 and R2 had major cognitive impairments. It was determined that an outside agency conducted an investigation regarding the allegation which did not determine that the allegation was factual. When interviewed by the outside agency, R1 stated that R2 had engaged in sexual misconduct that day. Interviews with outside sources revealed that the sexual misconduct R1 described in that interview had not occurred. Continued on LIC9099-C page... Unsubstantiated Interviews with staff and a tour of the facility determined that R2 had a room next to R1. Interviews with staff revealed that all residents at the facility had major cognitive impairments and had occasional behaviors of undressing and exiting their rooms. Staff denied that any of the undressing behaviors were done with a malicious intent. R2 would occasionally disrobe in their room in preparation for a shower. Staff indicated that R2 was a friendly individual and would attempt to say hello to R1 by waving their hand, which R1 would angrily react to. R1 was described by staff to be easily agitated by interactions with other residents. Ongoing negative interactions between the two residents were due to their cognitive impairment, however, no form of sexual abuse or misconduct could be verified. Interviews with staff did not support the allegation that R2 engaged in any sexual misconduct with R1 or any other residents. The Department has investigated the above-mentioned allegation and based on interviews and records review, the preponderance of the evidence has not been met, therefore, this allegation is deemed unsubstantiated. LPA was greeted by, identified herself to, and explained the purpose of the visit with Licensee Rigoberto Garcia. The facility is licensed for a maximum capacity of 6 residents, 5 of which may be non-ambulatory. The facility has a waiver for 2 hospice residents. During today’s visit, the facility had a census of 4 residents, 1 of which was non-ambulatory. LPA did not observe any aspects of delayed egress or secured perimeter. The Administrator for the facility is Rigoberto Garcia and their certificate expired on 6/21/2023. Review of the Department's Pending Administrator list revealed Garcia's renewal application was received on 5/9/2023 and was determined to be incomplete. During today’s visit, LPA toured the facility and inspected each room of the facility, including resident rooms, bathrooms for resident and staff use, kitchen, garage, common areas, and outside space. No bodies of water were observed near or on the premises. According to Rigoberto Garcia, no firearms or weapons are stored on the premises. The facility was found to be clean, safe, and in good repair with no pathway obstructions. The facility’s water temperature was measured at 115.2 degrees Fahrenheit and 118.6 degrees Fahrenheit in two common resident bathrooms. The facility’s internal temperature was measured at 71 degrees Fahrenheit. LPA observed locked storage for all hazardous and/or toxic chemicals and were stored separately from food supplies. LPA also observed locked storage for resident medications and resident and staff files. Resident medications are stored in their original container and label. LPA observed a 2-day supply of perishable food and a 7-day supply of non-perishable food present at the facility. The facility refrigerator was kept at 40 degrees Fahrenheit, and the facility freezer was kept at 0 degrees Fahrenheit. Continued on LIC809-C page... LPA observed linens and hygiene products provided to the clients that are in good repair and sufficient to meet their needs. Staff present at the facility during the time of the inspection had a criminal background clearance, were associated to the facility, and had a first aid certificate. LPA reviewed multiple resident and staff records. Review of resident records revealed that 1 of 4 resident records did not have an updated physician's report as required for a diagnosis of dementia. Each staff file was complete and contained a personnel record, first aid certificate, fingerprint clearance and association, and a health screening. LPA spoke with staff and residents present at the facility during the time of the inspection and those interviews did not reveal any licensing or regulatory concerns. The Licensee will submit copies of the LIC500 Personnel Report, LIC610E Disaster Plan, and current liability insurance to the Department within 15 business days. The following deficiencies for updated physician's report, Department review of records, and Certified Administrator are cited per California Code of Regulation, Title 22 and noted on the attached LIC809-D pages. An exit interview was conducted with Licensee Rigoberto Garcia, who refused to sign portions of the licensing documents.
