Allegation investigated: Staff did not follow resident's dietary needs Staff are using restraints on residents Staff did not provide proper care and supervision to resident.

Licensing Program Analyst (LPA) Jose Tan conducted an unannounced initial complaint visit at this facility to investigate the above allegations. LPA met with the Administrator Mary Jane Rivera and explained the reason for the visit. LPA conducted a physical plant tour at 12:10 PM, requested copies of facility documents relevant to the investigation at 12:23 PM, reviewed records between 12:30 PM to 1:30 PM and interviewed staff and residents between 1:30 PM to 3:00. Regarding the allegation that Staff did not follow resident's dietary needs, it was alleged that the staff are not following Resident #1 (R1)'s dietary restriction. LPA record review revealed that R1 had a medical condition that requires No Added Salt (NAS) and low to no sugar dietary restriction. LPA's interview with staff today revealed that they have three (3) residents with the same medical condition and have been preparing food for these residents for the last three (3) years so the staff is aware of the dietary restriction and have been preparing restricted diet for R1 since admission until R1 left. (continued on LIC 9099-C) Unsubstantiated (continued from LIC 9099) LPA's interview with Resident #2 (R2) today at 1:50 PM, who has the same medical condition, revealed that the staff always follow R2's dietary restriction and gave R2 food that is good for R2 such as vegetables and fruits and always reminds R2 about R2's medical condition and to get better. Regarding the allegation that the Staff are using restraints on residents, it was alleged that the staff restrained R1 in the wheelchair by a belt. LPA's record review today revealed that R1 has a physician's order for a wheelchair belt for safety. LPA's interview with the staff on 09/24/25 at around 12:30 PM, revealed that they only put the belt on R1 when they transport R1 from bed to the dining/living area as R1 was always trying to get up or stand up and always tried to get off the wheelchair while being transported to and from bed to the living/dining area. Regarding the allegation that Staff did not provide proper care and supervision to resident, it was alleged that the Reporting Party (RP) witnessed R1 to be in a “zombie” like manner while at the facility. LPA's interview with the Administrator today revealed that the Administrator was not aware of R1 being "zombie" like but noticed that R1's dementia was getting worse and seemed to be declining as R1 barely respond when talked to. LPA's interview with the only two (2) aware residents revealed that they were well taken care of by the staff and provided all the care they need. LPA attempted to interview the other four (4) residents but they were all in hospice service and unable to comprehend and/or converse coherently with LPA. Based on the information gathered during this and prior visit, these allegations are deemed unsubstantiated at this time. Exit interview conducted. Licensing Program Analyst (LPA) Jose Tan, met with staff Flora and Domingo Calderon for a One (1) year required visit for this facility. Staff called the administrator Mary Jane Rivera who arrived at the facility twenty (20) minutes later. LPA explained the reason for the visit. A tour of the physical plant was conducted at 9:13 AM and the following was noted: There is only one entrance being utilized at the facility. Screening area is located immediately upon entrance. Sign in sheet, hand sanitizer, gloves and masks are available. The facility had submitted and approved Infection Control and Mitigation plan. The facility has a designated visitors' area at the backyard. The facility has sufficient stock of PPE in the storage room. The facility has four (4) bedrooms and three (3) bathrooms currently occupying six (6) residents. One (1) bedroom and one (1) bathroom is designated for staff use. The facility is licensed to care for six (6) non-ambulatory resident and hospice waiver for six (6) residents. Physical environment was checked for cleanliness and condition. Walls, windows, ceilings, floors and floor coverings and doors were checked, the following was noted: Living and dining room furniture were also checked. The living room is neat and clean along with the dining room. The facility maintains a comfortable temperature at 76°F. The smoke detectors were tested and observed to be operational. There is a fire extinguisher located in the kitchen and was observed to be full and last serviced on 03/28/25. The backyard of the facility has outdoor furniture, with a covered shaded area for clients. There is no body of water in the facility. There is a locked shed being used as a used equipment storage. The garage is attached to the house but has no access from inside the house. It is also being used as laundry area, storage for frozen foods and old equipment. All the laundry detergents, cleaning solutions, toxins and other chemicals are observed to be locked in a cabinet and inaccessible to residents. Food Service/Kitchen area was sufficiently stocked with two (2) days perishable and seven (7) days of non-perishable food. Frozen foods are properly wrapped and stored appropriately. Food storage and preparation areas are clean and inaccessible to pests. All sharps and knives were also observed to be locked in the kitchen cabinet below the sink. The Clients' rooms are adequately furnished with appropriate furniture and lighting system. Hall ways/passage ways are lit. Clients have sufficient amounts of personal hygiene product which is provided by the licensee. Staff Rooms: Staff room was locked. No medications are observed in the staff room. The bathrooms were checked for cleanliness and proper operation. LPA observed the appropriate grab bars for each toilet, bathtub and shower. Sink in the bathrooms were removed and under construction. The hot water temperature measured at 107.4°F. Towels and washcloths are not shared. There is enough clean linen available in stock at the cabinet. Medications: LPA observed medication in the living room cabinet to be locked and inaccessible to residents. Medications are listed on the centrally stored medication and destruction record. There is a complete first aid kit located in the medication cabinet. Client records: Client records are reviewed. all residents' file appeared to be complete and updated. One (1) resident however is bedridden and the facility has no bedridden fire clearance. Staff records: LPA conducted a complete file review of staff records. Staff records observed to be complete and updated. Disaster drill was last conducted on 10/28/25. Required posting are observed to be complete and current and displayed properly at the facility. Licensing Program Analyst (LPA) Gary Tan conducted an unannounced case management visit at this facility to follow up on the exclusion of one the staff of the facility. A Decision and Order regarding Staff #1 (S1)'s immediate exclusion from the facility was effective 12/28/23 During today’s visit LPA read and reviewed the Decision and Order with the Administrator and verified that the administrator has received a copy of the order and staff are aware that S1 is no longer allowed to visit this and any of their facility. LPA interviewed both staff at the facility and stated that S1 has never visited the facility since June of last year. No citations issued during today's visit. The Administrator was not available today due to prior personal commitment and designated staff Flora Calderon to sign the report. Exit interview conducted. Client records: Client records are reviewed, Three (3) out of five (5) had a diagnosis of dementia and no updated medical assessment on file. Staff records: LPA conducted a complete file review of staff records. Two (2) out of two (2) staff records reviewed did not have health screening on file.
