Allegation investigated: Staff did not provide a 60-day written notice to the resident or the residents' representative for increase in fees. Staff did not provide a detailed explanation of the additional services to be provided at the new level of care.
This report is being amended to address typographical errors and supersedes the amended report dated March 19, 2026. The findings remain the same. Licensing Program Analyst (LPA) Abeye Duguma conducted an unannounced subsequent complaint visit to the facility, met with Helen Fegan, and explained the reason for the visit. LPA spoke with the administrator, Waldi Trudez, and she designated Fegan to sign and accept this report. -- Staff did not provide a 60-day written notice to the resident or the residents' representative for increase in fees. It was alleged that proper notification from the licensee regarding multiple rate increases of $50.00, $100.00 and $200.00 was not received. To investigate the above allegation, on March 19, 2026, LPA requested documents at around 10:00a.m. and interviewed one staff from 11:30a.m. – 12:30p.m. During interviews the investigation determined the Licensee was unable to provide proof of timely rate increase notification. Licensee stated facility refunded R1 in full. (CONT. LIC9099-C) Substantiated This continuation report is being amended to address typographical errors. The findings remain the same. ----Staff did not provide a detailed explanation of the additional services to be provided at the new level of care. It was alleged that resident did not receive a detailed explanation as to why the level is increasing. To investigate the above allegation, on March 19, 2026, LPA requested documents at around 10:00a.m. and interviewed one staff from 11:30a.m. – 12:30p.m. During interviews, the investigation determined the Licensee was unable to provide a reason or documentation as to why levels were increasing. During interviews, staff stated facility refunded R1 in full. Based on interviews, there is enough information to verify the allegations, therefore, the allegations are SUBSTANTIATED at this time. Pursuant to Title 22 Division 6 Chapter 8 of the CA Code of Regulations, the following deficiencies were cited (refer to LIC 9099-D): No health and safety hazards noted during the visit. Type of visit: Case Management - Deficiencies
At approximately 9:45 a.m. on 03/05/26 Licensing Program Analyst (LPA) Nicholas Reed conducted an unannounced case management visit in conjunction with complaint visit for investigation #31-AS-20260227093402. LPA met with staff and disclosed the reason for the visit. During the complaint visit, LPA observed Staff #1 (S1) in the facility providing care and supervision to residents. S1 was not associated to the facility. Interview with the licensee at 1:45 p.m. today revealed S1 was not associated to the facility but had a criminal background clearance. The licensee stated S1 had worked in the home for one (01) month. At 2:00 p.m., LPA conducted a file review and did not find S1’s criminal background clearance. A deficiency is issued for S1 working in the facility for more than five (05) days without a criminal background clearance. A civil penalty in the amount of $500 is hereby assessed. Type of visit: Required - 1 Year
Licensing Program Analyst (LPA) Abeye Duguma met with Eileen Calderon for a Required One (01) Year visit. LPA explained the reason for the visit. A tour of the physical plant was conducted at around 10:00 AM and the following was noted: The facility has outdoor furniture with a covered shaded area for residents and visitors. The facility does not have a swimming pool/body of water. The garage is currently being used for storage. The facility is fire cleared for five (05) non-ambulatory. The facility is currently occupying three (03) residents. The facility has a total of four (04) bedrooms of which three (03) are for residents and two (02) bathrooms. The living and dining room are neat and clean. The residents' rooms are furnished with appropriate lighting system. Hallways are well lit. Kitchen is sufficiently stocked with at least two (02) days perishable and seven (07) days non-perishable food. Frozen foods are wrapped and stored appropriately. Food storage and preparation areas are clean and inaccessible to pests. Knives and sharps are observed to be locked and inaccessible to residents. (continued on LIC 809-C) The bathroom was checked for cleanliness and proper operations. The hot water temperature was measured at 117.8°F. There was enough clean linen available. Towels and washcloths are not shared. Residents have enough personal hygiene product provided by the licensee. The facility maintains a comfortable temperature at 72°F. The smoke and carbon monoxide detectors are hardwired, interconnected and observed to be operational. Fire extinguisher is located near the kitchen and observed to be fully charged and last inspected 03/28/2025. Laundry detergents, cleaning agents and other toxins are locked away. LPA observed medication to be locked and inaccessible to residents. Facility maintains a complete first aid kit. During staff file review, LPA noted First Aid CPR training certificates have expired for both caregivers on site. Pursuant to Title 22 Division 6 Chapter 8 of the CA Code of Regulations, the following deficiencies were cited (refer to LIC 809-D): No other health and safety hazards noted during the visit. A tour of the physical plant was conducted at around 9:45 AM and the following was noted: There is one entrance being utilized at the facility. The facility has a total of four (04) bedrooms of which three (03) are for residents and two (02) bathrooms. The facility is fire cleared for five (05) non-ambulatory. The facility is currently occupying four (04) residents. The facility has outdoor furniture with a covered shaded area for residents and visitors. The facility does not have a swimming pool/body of water. The garage is currently being used for storage. Laundry detergents, cleaning agents and other toxins are locked away. Kitchen is sufficiently stocked with at least two (02) days perishable and seven (07) days non-perishable food. Frozen foods are wrapped and stored appropriately. Food storage and preparation areas are clean and inaccessible to pests. Knives and sharps are observed to be locked and inaccessible to residents. The living and dining room are neat and clean. The facility maintains a comfortable temperature at 74°F. The smoke and carbon monoxide detectors are hardwired, interconnected and observed to be operational. Fire extinguisher is located near the kitchen and observed to be fully charged and last inspected 04/29/2024. (continued on LIC 809-C) The residents' rooms are furnished with appropriate lighting system. Hallways are well lit. Residents have enough personal hygiene product provided by the licensee. The bathroom was checked for cleanliness and proper operations. The hot water temperature was measured at 112.3°F. Towels and washcloths are not shared. There was enough clean linen available in the cabinets. LPA observed medication to be locked and inaccessible to residents. Facility maintains a complete first aid kit. During the physical plant tour, LPA observed three beds with full or half railing. Of the two beds in room #4, one was full and the other half railing. The bed in room #3 is half railing only. LPA requested a written order from a physician indicating the need for the postural support, however, staff was unable to furnish such documents. Pursuant to Title 22 Division 6 Chapter 8 of the CA Code of Regulations, the following deficiencies were cited (refer to LIC 809-D): No other health and safety hazards noted during the visit. Allegation investigated: Resident's responsible party was not informed of a change in resident's care. Facility mismanaged resident's medications.
At 3:00pm, Licensing Program Analysts (LPAs) Angela Panushkina and Michael Cava conducted an unannounced subsequent visit to deliver final findings. LPAs met with the staff, Eileen Calderon, and explained the reason for the visit. During the initial visit, conducted on 12/01/21, by LPA Panushkina interviews and records review were made. At 10:05am, LPAs requested resident and staff roster. At 10:10am, LPAs requested copies of pertinent information which include, but not limited to Physician’s Report, Centrally stored Medication and Destruction Records (CSMDR), relevant to the investigation. At approximately 10:15am, LPA conducted a physical plant tour, to ensure health and safety of the residents are protected and physical plant is in compliance with Title 22 Regulations. Between 10:20am – 12:00pm, LPA conducted an interviewed the Administrator and two (2) staff members. Continue on LIC9099-C Unsubstantiated Resident's responsible party was not informed of a change in resident's care. It was alleged that the R1’s responsible party was not informed that R1 was prescribed an antidepressant when placed to this facility. To investigate this allegation, LPA conducted an interview with the Administrator and two (2) staff members and was informed that the facility always follows doctor’s orders. In addition, two (2) staff members also informed LPA that R1 was not prescribed antidepressant upon admission and a copy of all prescribed medications were provided to R1’s responsible party. Moreover, LPA conducted review of R1’s Centrally stored Medication and Destruction Records (CSMDR) and did not observe R1 being prescribed with an antidepressant. Therefore, based on interviews and record reviews this allegation is deemed Unsubstantiated at this time. Facility mismanaged resident's medications. It was alleged that the facility received an order for R1’s doctor for a new prescription, Citalopram 10MG, and did not notify R1’s responsible party. To investigate this allegation, LPA conducted an interview with the Administrator and two (2) staff members, and all parties interviewed denied the above allegation. Two staff members interviewed denied ever receiving and or administering that medication to R1. Moreover, LPA conducted review of R1’s Centrally stored Medication and Destruction Records (CSMDR) and did not observe R1 being prescribed Citalopram upon admission nor thereafter. Therefore, based on interviews and record reviews this allegation is deemed Unsubstantiated at this time. No Deficiency cited. Licensing Program Analyst (LPA) Abeye Duguma met with caregiver, Elizabeth Calderon, for a Required One (01) Year visit. LPA explained the reason for the visit. LPA spoke with the co-administrator, Waldi Lopez, and she designated Elizabeth Calderon to sign and accept the report. A tour of the physical plant was conducted at 12:40 PM and the following was noted: There is one entrance being utilized at the facility. The facility has a total of four (04) bedrooms of which three (03) are for residents and two (02) bathrooms. The facility is fire cleared for five (05) non-ambulatory. The facility is currently occupying three (03) residents. The facility has outdoor furniture with a covered shaded area for residents and visitors. The facility does not have a swimming pool/body of water. The garage is currently being used for laundry and storage. Laundry detergents, cleaning agents and other toxins are locked away. Kitchen is sufficiently stocked with at least two (2) days perishable and seven (7) days non-perishable food. Frozen foods are wrapped and stored appropriately. Food storage and preparation areas are clean and inaccessible to pests. Knives and sharps are observed to be locked and inaccessible to residents. The living and dining room are neat and clean. The facility maintains a comfortable temperature at 72°F. The smoke and carbon monoxide detectors are hardwired, interconnected and observed to be operational. Fire extinguisher is located between the kitchen and dining area, observed to be full and last inspected on 06/05/2023. (continued on LIC 809-C) The residents' rooms are adequately furnished with appropriate lighting system. Hallways are well lit. Residents have enough personal hygiene product provided by the licensee. The bathroom was checked for cleanliness and proper operations. The hot water temperature was measured at 117.1°F. Towels and washcloths are not shared. There was enough clean linen available in the cabinets. LPA observed medication and first aid kit to be locked and inaccessible to residents.
