Type of visit: Required - 1 Year
Licensing Program Analyst (LPA) Michael Cava conducted an Annual Required visit and inspection of the facility. LPA met with the administrator, Nazar "Nick" Yegeyan and explained the reason for the visit. The facility is a one story building. It is located behind the property of the 17177 San Jose Street address (licensed facility). There is no swimming pool or bodies of water on property. The smoke alarms are hardwired. There are carbon monoxide works dual with the smoke alarms. The fire extinguisher is located by the kitchen. It was purchased on 03/25/25. Kitchen: The kitchen appliances and fixtures were functional. LPA found a sufficient amount of perishable and non-perishable food at the facility; properly stored. Knives were stored in a locked box inside a kitchen drawer. Bedrooms: There are three (3) bedrooms designated for residents' use. The three bedrooms are shared. Bedrooms were properly furnished with appropriate beddings and linens. There was also sufficient lighting and closet space. Bathrooms: There are two (2) bathrooms. Bathrooms were properly supplied and had functional fixtures. Hot water temperature was measured between 109 to 110 degrees Fahrenheit. Common Areas: These included the living room and dining area. Furniture is maintained and in good repair. The dining room table is large enough to seat up to six residents. Floors were mopped and clean. Hallway and passageways were clear of obstruction. The auditory alarms on all exit doors were on and functional at the time of the visit. Surrounding Grounds: The outdoor front patio is shared with the front property. There is also a backyard patio. Both front and back yards had furniture appropriate for outdoor use. The outdoor area was free of hazards. The back of the home has a locked storage for cleaning supplies. Laundry Area: The laundry area is located in the hallway by the resident rooms. No detergents or cleaning supplies observed. Garage: There is no garage. Resident Files: Resent files are maintained in a locked cabinet by the kitchen. LPA conducted a file review of resident records to insure compliance of licensing forms. Staff Files: Staff files are als maintained in a locked cabinet by the kitchen. LPA conducted a file review of staff records to insure forms and training are up to date and compliance with licensing forms. Medications: Medication and Medication Records are stored in a locked cabinet by the kitchen. Medications and medication records were reviewed for proper storage and documentation. Pursuant to Title 22 Division 6 of the CA Code of Regulations, there were no deficiencies observed during the visit. It is located behind the property of the 17177 San Jose Street address (licensed facility). There is no swimming pool or bodies of water on property. The smoke alarms are hardwired. There are carbon monoxide works dual with the smoke alarms. The fire extinguisher is located by the kitchen. It was purchased on April 11. 2024. There is an additional fire extinguisher by the dining area. Kitchen: The kitchen appliances and fixtures were functional. LPA found a sufficient amount of perishable and non-perishable food at the facility; properly stored. Knives were stored in a locked box inside a kitchen drawer. Bedrooms: There are three (3) bedrooms designated for residents' use. The three bedrooms are shared. Bedrooms were properly furnished with appropriate beddings and linens. There was also sufficient lighting and closet space. Bathrooms: There are two (2) bathrooms. Bathrooms were properly supplied and had functional fixtures. Hot water temperature was measured at 116 degrees Fahrenheit. No cleaning supplies were observed. Common Areas: These included the living room and dining area. The living room had a couch, television, and additional seating. The dining room table is large enough to seat up to six residents. Furniture is maintained and in good repair. Floors were mopped, cleaned, and clear of obstruction. The auditory alarms on all exit doors were on and functional at the time of the visit. Surrounding Grounds: Entry/exits were free of obstruction. The outdoor front patio is shared with the front property. There is also a backyard patio. Both front and back yards had furniture appropriate for outdoor use. The outdoor area was free of hazards. The back of the home has a locked storage. Oct 22, 2024Complaint investigation reportUnsubstantiated
Allegation investigated: Facility did not refund prepaid monthly fee to resident Staff yelled at resident
Licensing Program Analysts (LPAs) Gary Tan and Michael Cava conducted a complaint visit to the facility to investigate the above allegations. LPAs met with the administrator, Nazar "Nick" Yegeyan, and advised him of the complaint. Today's investigation consisted of interviews with the administrator, staff, residents, record review, and a physical plant inspection to insure the health and safety of the residents in care. Facility did not refund prepaid monthly fee to resident: In regards to the allegation, it was reported that Resident 1 (R1) moved out of the facility on 9/17/24 and removed all of their belongings. Two weeks prior to moving out R1 was advised by the owner that they would receive a refund for one half of the month (Sept 2024). R1’s monthly rent was $3,750.00 and was expecting a refund in the prorated amount of $1,875.00, however, the owner refused to issue a refund. Interviews with administrator denies the allegation of ever refusing a refund stating so long as it complies with the facility admission agreement, a refund will be issued. R1 moved into the facility on 07/15/24, and moved out Unsubstantiated on 08/19/24. R1 moved out of the facility voluntarily, without giving the administrator a thirty (30) day notice. Moreover, R1 only paid for the month of July, leaving three days in August unaccounted for and overdue. A review of R1's admission agreement, signed by R1 on 07/15/24, reveal that their monthly rate is $3,500. Further review of the admission agreement state that "If the Resident leaves the facility for other than a medical condition, a thirty (30) day notice to the facility is required. If the required notice is not provided, the full month's rate is due". Based on the information obtained, there was insufficient evidence to prove that the facility did not refund a prepaid monthly fee to R1. Therefore, the allegation is deemed Unsubstantiated at this time. Staff yelled at resident: In regards to the allegation, it was reported that when the administrator refused to provide R1 with a refund, the administrator also yelled at R1. No witnesses were identified to corroborate with the allegation. Interview with the administrator and staff deny the allegation of administrator ever yelling at R1. Interviews with five (5) of five residents also deny that administrator has ever yelled at them. These residents also could not confirm if the administrator has ever yelled at R1. Based on the information obtained, there was insufficient evidence to prove that staff yelled at R1. Allegation investigated: Staff inappropriately touched resident. Staff physically abused resident. Staff verbally abused resident.
Licensing Program Analyst (LPA) Michael Cava conducted a subsequent complaint visit to the facility to conclude the investigation regarding the above allegations. It was reported that staff were verbally and physically abusive towards Resident 1 (R1) and staff inappropriately touched R1 at the breast area. The ten day visit was initiated by LPAs Mariana Agban and Michael Cava on 03/20/24. That visit consisted of interviews with both facility administrators, Nazar "Nick" Ygeyan, and Mary Yegeyan, and five (5) of five residents. A physical plant inspection was also made to insure the health and safety of the residents. The complaint was also referred to Investigations Branch (IB) on 03/20/24, and accepted as an assignment for IB Investigator Christine Ferris to conduct interviews to address allegation #1. Staff inappropriately touched resident: On 03/25/24 IB Ferris conducted interviews with R1 and Resident 2 (R2). R1 stated to IB that they “are in a safe place, and nobody is mistreating them or hurting them here”. Interview with R2 also made and Unsubstantiated R2 stated that the facility is a “safe and wonderful place”. In addition, R2, who is friends with R1, “denies seeing any inappropriate behavior by staff towards R1 or any of the other residents in care”. Based on the information obtained by IB, there was insufficient evidence to corroborate the allegation of staff inappropriately touching R1. Therefore the allegation is deemed Unsubstantiated at this time. Staff physically abused resident/staff verbally abused resident: On 03/20/24, LPAs Agban and Cava conducted the initial 10 day visit to the facility. Investigation on that day consisted of interviews with five (5) of five residents and both administrators, Nazar "Nick" Ygeyan, and Mary Yegeyan. Both administrators deny the allegations of abuse. Interviews with the five residents also deny both allegations of physical and verbal abuse, and did not express any concerns or complaints regarding staff. On 04/17/24, LPA Cava conducted interviews with one (1) of one staff who also deny both allegations of abuse. Based on the information obtained, there was insufficient evidence to corroborate the allegations of staff being physically and verbally abusive to the residents in care. There are carbon monoxide works dual with the smoke alarms. There are two new fire extinguishers. Both fully charged. One fire extinguisher is located at the kitchen, and the other in the hallway. Kitchen: The kitchen appliances and fixtures were functional. LPA found a sufficient amount of perishable and non-perishable food at the facility; properly stored. Knives were stored in a locked box inside a kitchen drawer. Bedrooms: There are three (3) bedrooms designated for residents' use. The three bedrooms are shared. Bedrooms were properly furnished with appropriate beddings and linens with sufficient lighting. Bathrooms: There are two (2) bathrooms. Bathrooms were properly supplied and had functional fixtures. Hot water temperature was measured at 107 degrees Fahrenheit. No cleaning supplies were observed. Common Areas: These included the living room and dining area. The common areas were properly furnished. The dining room table is large enough to seat up to six residents. Floors were cleaned, maintained and clear of obstruction. The auditory alarms on all exit doors were on and functional at the time of the visit. All exits were clear of obstruction. Surrounding Grounds: Entry/exits were free of obstruction. The outdoor patio is shared with the front property. There was furniture appropriate for outdoor use. The outdoor area was free of hazards. The back of the home has a locked storage. The laundry area is located in the hallway by the resident rooms. No detergents or cleaning supplies observed. Resident and staff files are maintained in a locked cabinet by the kitchen. Resident Files: LPA conducted a file review of resident records to insure compliance of licensing forms. Staff Files: LPA also conducted a file review of staff records to insure forms and training are up to date and compliance with licensing forms. Medications: Medication and Medication Records are stored in a locked cabinet by the kitchen. Medications were reviewed for proper storage and documentation. Pursuant to Title 22 Division 6 of the CA Code of Regulations, there were no deficiencies observed during the visit.
