Merced Girard Residential Care Facility

On 8/26/2026, LPA Grace Donato made an unannounced annual visit to the facility. LPA met with Administrator Michael Lee. LPA explained the purpose of the visit. LPA toured the facility inside and outside including all of resident rooms, common areas, kitchen area. The indoor and outdoor passageways were free of obstruction. Facility is a three story building. LPA observed some residents were in the living room watching tv. While touring the facility it was observed that the room temperature was at 70 deg F. The residents have adequate amount of linens and incontinence care items. All personal belongings are intact. All fire extinguishers have been checked and current. Resident bedrooms and bathrooms were observed to be in good repair equipped with grab bars and non-skid floor. Facility has 2 days for perishables and & 7 days non-perishable. Emergency drills are logged and done every quarter. Five resident records and three staff records were reviewed. Resident records are updated, complete and signed. Staff records are complete, with training logs that have met the basic 20hr requirement. Facility accepts hospice residents and are in compliance with the required waiver requirements. Medication review was done, and all medications are accounted for, and centrally stored medication records are updated. No deficiencies are cited at this time. On 07/10/2025 Licensing Program Analyst(LPA) Yi Sam Jian arrived at the facility to conduct the Annual 1-year required visit. LPA was greeted by Michael Lee, administrator and explained the purpose of the visit. LPA toured the physical plant , consisting of 3 floors and a basement level. There is a garage, where washer and dryer are located. The backyard is enclosed and does not have access to the street. Kitchen, dining room and office are located on top floor. The kitchen was inspected, and a sufficient supply of food was observed. Infection control practices were reviewed. Medications, toxins, and sharps were stored appropriately and kept inaccessible to clients. A comfortable temperature was maintained throughout the facility, with hot water temperature inspected to be in compliant. Furnishings and lighting were adequate for comfort and safety. All hallways, passageways, and the backyard were observed to be free of hazards and obstructions. The carbon monoxide and smoke detection systems were inspected and meet required standards. The fire extinguisher was checked and is fully charged. The first-aid kit was inspected and is complete. No deficient is cited today. This report is reviewed and discussed with administrator. Allegation investigated: -Facility staff's neglect/lack of care and supervision led to resident death. -Facility staff failed to seek timely medical attention for resident admitted to the hospital with septic condition.

On 06/05/2025 Licensing Program Analyst (LPA) Yi Sam Jian conducted an unannounced complaint inspection to deliver findings regarding the complaint allegations received. LPA met with administrator, Joyce Lee, LPA explained the purpose of the visit. Regarding the allegation that facility staff’s neglect/lack of care and supervision led to resident death. Although resident appeared stable with no alarming symptoms reported by staff, hospital physician noted that while earlier intervention might have helped, sepsis can develop rapidly in the elderly without obvious signs, and the family's decision to pursue comfort care was appropriate. Regarding allegation that facility staff failed to seek timely medical attention for resident admitted to the hospital with septic condition. Resident’s medical records show her chief complaint was shortness of breath and she was diagnosed with sepsis, hypovolemic shock, and recurrent stroke, with staff and the administrator reporting no significant changes before hospitalization, and the attending physician noting that in elderly patients, infections like UTIs and sepsis can progress rapidly with few or no symptoms. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove whether the allegations did or did not occur, therefore the above allegations are UNSUBSTANTIATED. Allegation investigated: - Facility staff did not seek medical attention for resident in a timely manner - Facility staff yelled at resident in care

On 10/21/2024, Licensing Program Analyst (LPA) Jaime Vado conducted an unannounced complaint investigation visit in order to deliver findings regarding the complaint allegations received. LPA met with staff initially then the administrator Michael Lee. During the investigation LPA conducted interviews and reviewed pertinent documents related to the allegations. Per interviews with facility staff, medical attention was sought for the resident when they were alerted by the family of the resident that there was a possible medical issue. Staff attested to caring and feeding the resident that morning and bringing the resident to their room per resident request with no issues. Regarding the staff yelling, LPA could not determine if this took place and per observations and interviews, its common for staff to speak loudly to each other but not in an angrily way directed toward residents per observations and interviews conducted. During the investigation LPA could not prove or disprove that the allegations took place and due to conflicting information the allegations are unsubstantiated. Based on these observations, the above allegations are UNSUBSTANTIATED. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the above allegations are unsubstantiated at this time. On 8/28/2024, Licensing Program Analysts (LPAs) Murial Han and Yi Sam Jian conduced an annual inspection. Upon entrance, LPAs were greeted by caregiver, Miao Fen Yu and LPAs explained the purpose of the visit. The administrator, Michael Lee arrived shortly thereafter and assisted with the inspection. LPAs toured the facility. This facility is 3 floors and a basement level. There are no obstructions blocking indoor and outdoor passageways. No pools or bodies of water observed. Backyard is fenced, secured, and in good condition. Facility temperature is comfortable measured at 72F per thermostats observed and lighting is sufficient for comfort. Resident rooms are on the 1st, 2nd and 3rd floor with double occupancy. Extinguishers last inspected on 6/18/2024 and emergency drills were reviewed. Spare linens and blankets are observed. Cleaning solutions are stored and locked in basement level. LPAs reviewed 2 day perishable and 7 day nonperishable food supplies as in place. Additional food supplies are located in the basement level which contains 2 large freezers and additional canned and fresh produce. Central stored medication, toxins and sharps objects were locked and inaccessible to residents. A review of (6) resident files was conducted and noted on the LIC 858. A review of (4) staff files was conducted and noted on the LIC 859. During the tour with the administrator, LPAs observed a resident's over bed table has silver tape all around the edges, bathroom doors has chipped paint on the bottom, bathroom door frames have chipped paint and broken wood on the bottom, two of the kitchen cabinet doors are broken, a couch on the 2nd floor has silver tape around the right armrest, the toilet paper on the 3rd floor bathroom is held up by a plastic bag, broken floor in front of a resident's room on the 2nd floor and multiple chipped doors and door frame edges through-out the facility. LPAs requested for the following documents to be submitted to CCL by 8/30/2024 to update the administrator: LIC 500, LIC 503, LIC 308, a written letter from the licensee appointing the administrator and a copy of the administrator certification or proof that it is in the process of being renewed. Based on observation, deficiency is cited under California Code of Regulations, Title, 22 cited on the LIC 809D. Failure to correct the deficiencies may result in civil penalties.
