Allegation investigated: Staff are impeding Ombudsman's investigation

Licensing Program Analyst (LPA) Abdoulaye Zerbo conducted a subsequent complaint visit to deliver final findings for the above allegation. During today’s visit, LPA met with Executive Director (ED) Eloiza Castellanos and explained the reason for the visit It was alleged that Staff are impeding Ombudsman's investigation. LPA interviewed the ED and the information obtained revealed that the facility staff did not refuse to provide the Ombudsman with the requested contact information. Rather, ED sought clarification and written guidance regarding the scope and legal basis of the request, particularly in light of recent events involving a memory care resident with a dementia diagnosis, who was having issues with the Power of Attorney. Following this incident, the Ombudsman requested a list of all memory care residents, and their responsible parties contact information. Licensing Program Analyst (LPA) Michael Cava conducted a subsequent complaint visit to the facility to conclude the investigation regarding the above allegations. LPA met with the Business Manager (BM), Kimberly Pedrosa, and advised her of the complaint. The ten day visit was made by LPA Yolanda Delgado on 09/26/22. Today's investigation consisted of of interviews with the BM, staff and residents. A physical plant inspection was also made. Facility phones are not not being answered: In regards to the allegation, it was reported that calls to facility were made in the past, to no answers by staff. Dates and times have not been identified to this allegation. Between 9:20am to 10:20am, interviews with the BM and three (3) of three staff deny the allegation. Between 10:20am and 11:20am, interviews with ten (10) of ten residents expressed no complaints or concerns regarding phone service. In conjunction to complaint control #18-AS-20220923161355, Licensing Program Analyst (LPA) Michael Cava also conducted a subsequent complaint visit to the facility to conclude the investigation regarding the above allegations. LPA met with the Business Manager (BM), Kimberly Pedrosa, and advised her of the complaint. The ten day visit was made by LPA Stephanie Torres on 07/02/21. Today's investigation consisted of of interviews with the BM, staff and residents. A physical plant inspection and record review was also conducted. Staff did not address a resident's toileting needs while in care/Resident was left soiled while in care: In regards to the allegation, it was reported that on or around April 11, 2021, Resident 1 (R1) was observed sitting on their own feces. Feces was also observed on R1's bathroom and recliner. This wasn't the first time similar incident like this had occurred. Licensing Program Analyst (LPA) Rayshaun Nickolas visited the facility announced to deliver the finding on the above allegation. LPA met with General Manager Eloiza Castellanos and explained the purpose of the visit. Department staff initiated the initial 10-day visit and collected pertinent information relevant to this investigation. LPA Nickolas reviewed evidence collected during the initial 10-day visit. The allegation alleged that the facility is under staff. The allegation alleged that the residents waited 30 minutes after activating their call button to receive assistance because the facility was not sufficiently staffed. Department staff investigation revealed that 11 residents had private caregivers during the initial complaint investigation. LPA Nickolas reviewed the facility’s pendant response time report for the week of August 1, 2021, through August 10, 2021, for 33 caregivers. Licensing Program Analyst (LPA) Yolanda Delgado arrived to the facility unannounced to conduct an investigation into the above allegation. LPA spoke with Resident One (R1) and Staff One (S1)-Administrator determined through the interviews, the allegation was UNFOUNDED. R1 stated that this is soley done as voluteered by R1 and no staff of the facility is in charge. R1 has taken on the task and is responsible for raising funds and R1 stated this is the fourth year. This agency has investigated the complaint alleging (Staff solicited funds from residents for personal gain). We have found that the complaint was unfounded, meaning that the allegation was false, could not have happened and/or is without a reasonable basis. There were no deficiencies and no civil penalties that were cited per Title 22, Division 6, of the California Code or Regulations. LPA met with Health and Wellness Director Roxanne Cerrasco. The investigation consisted of interviews and review of pertinent documents. Regarding the first allegation, Resident had multiple falls in the facility resulting in injuries. Relevant Party stated Resident 1 (R1) has had multiple falls with injuries due to lack of staff presence. Interviews with Staff and R1 revealed R1 has had multiple falls, but they did not result in injuries. Staff stated on one occasion, R1 did get a skin tear on their arm. The documents reviewed were consistent with the falls with no injuries. Regarding the second allegation, Staff left resident on the toilet for extended period of time. Interviews with Staff and R1 revealed staff do not leave R1 on the toilet for extended periods of time. Staff stated that Resident 1’s (R1’s) primary care physician (PCP) and responsible party (RP) were notified regarding R1’s change in condition. Facility documents indicate PCP was notified. There are no facility documents indicating the RP was notified. RP stated they were not contacted by the facility regarding R1’s change in condition. PCP was unable to be contacted refute or corroborate or refute the allegation. Based on interviews and documentation, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.
