Licensing Program Analyst (LPA) Cassandra Mikkelson arrived unannounced and met with Licensee Liviu Magurean to conduct an annual inspection utilizing the inspection tool. LPA conducted an inspection of the care home to ensure compliance with Title 22 regulations. LPA observed resident rooms, common area bathrooms, kitchen, common areas, and perimeter of care home. LPA observed rooms to be properly furnished, with appropriate bedding and lighting. The bathrooms were in sanitary condition, properly maintained, and the hot water temperature was observed to be 120.0 degrees F. LPA checked the kitchen area for the ability to prepare and store food. Care home has required (2) two day perishable and (7) seven day non-perishable food supply on hand. Smoke detectors and carbon monoxide detectors are operational in the care home. Fire extinguishers and first aid kit are maintained and ready for emergency use. LPA checked medication storage and found medications to be locked away and inaccessible to the residents. LPA reviewed six (6) resident files, two (2) staff files and resident medications. Facility has a current copy of certificate of liability insurance and LPA obtained a copy. As a result of this visit, no deficiencies were cited pursuant to California Code of Regulations, Title 22, Division 6, Chapter 8. Allegation investigated: Staff did not ensure adequate care and supervision was provided resulting in resident ingesting foreign objects

Licensed Program Analyst (LPA) Cassandra Mikkelson arrived at the facility unannounced and met with Licensee Levi Magurean to deliver findings for the above complaint allegation. During the investigation, LPA conducted interviews, conducted a tour of the facility, and reviewed documentation pertinent to the investigation. The results of the investigation are as follows: *** Report continued on 9099-C*** Unfounded During the investigation, LPA interviewed staff, administrator, and Licensee regarding the above allegation. Interviews conducted indicated that resident R1 was completely immobile, unable to turn themselves in their own in bed and unable to reach for items. R1 was under the care of hospice and due to physical decline, R1 was bedridden. Interviews conducted with staff member (S1) indicated that they checked on R1 every fifteen to thirty minutes to ensure R1was comfortable. Interviews conducted with S1, Administrator and Licensee indicated that the staff are trained to take out the resident trash at least one time daily or immediately if any hazardous items are placed in the trash during care. S1 indicated they conducted body checks of R1, which included checking their mouth due to R1 no longer drinking fluids on their own and only getting fluids through a moistened sponge. S1 indicated nothing was ever found in R1’s mouth. LPA toured the facility with Administrator and Licensee. LPA observed resident rooms were clean and all trash bins were empty for each room and out of reach of each resident’s bedside. LPA viewed all resident medications, cleaning products and hazardous items were locked away and inaccessible to residents in care. LPA reviewed documentation that was pertinent to the investigation. Documents indicated that hospice was visiting R1 on a daily basis and documented visit notes from each visit. Documents also indicated the time and date R1 received medications for pain management from facility staff and hospice staff. Based on this information as well as LPA observing staff’s regular garbage removal, there is no evidence that multiple syringe caps could be found in the residents garbage pail. Based on records reviewed and interviews, LPA finds the above allegations to be UNFOUNDED- meaning that the allegations were false, could not have happened and/or is without reasonable basis. On 5/2/2024 LPA Tryon visited the facility to do an annual visit. LPA was greeted by staff Jemilee Samuels LPA toured the facility including common areas, kitchen, bedrooms, bathrooms, hallways, garage, storage, yard. The home is in nice condition, well-kept and nicely furnished. Food supplies are appropriate to meet the requirement of 7 days non-perishable and 2 days perishable. Medications are centrally stored, locked and labeled. Home has adequate supply of cleaners and household goods; potentially dangerous items are secured. Bathrooms have non-skid surfaces in showers, grab bars, plumbing fixtures are in good condition and work properly. LPA reviewed the RCFE CARE Tool. LPA reviewed 2 staff files and 2 resident files. Staff and resident files have required documents. Smoke and carbon monoxide detectors installed and functioning. Fire extinguisher present and charged. Activities such as video and games present. Appropriate postings present regarding reporting abuse, Infection Control posters, rights, evacuation routes, etc. At this time the facility appears to be in substantial compliance. Licensing Program Analyst (LPA) Cassandra Mikkelson arrived at the facility and met with Levi Magurean. LPA discussed the reason for the visit. LPA observed one (1) staff working at the facility who is not fingerprint cleared. Administrator stated they have been working since February 1, 2025 and staff were not fingerprint cleared. Fingerprints were submitted to DOJ but LIC9163 was missing information so fingerprints could not be processed. LPA and Administrator discussed that all staff must be fingerprint cleared prior to working at the facility. As a result of this visit, a deficiency has been cited on the 809-D. Plan of correction: Licensee removed caregiver from the facility immediately. Staff cannot come back to facility until fingerprint cleared. Licensee will submit a statement of understanding to LPA that all staff must be fingerprint cleared prior to working in the facility.
