Type of visit: Required - 1 Year
Licensing Program Analyst (LPA) Kevin Mknelly arrived at the facility unannounced on 05/06/2026 to conduct a Annual Inspection utilizing the CARE inspection tool. LPA met with staff and explained the purpose of the visit. LPA requested for staff to notify Administrator that LPA is present at the facility to conduct an annual inspection. Administrator/ designee arrived to assist. LPA toured the interior and exterior of the facility together with staff to ensure health and safety of residents in care. Areas toured include but are not limited to: common areas, resident bedrooms, bathroom, kitchen, laundry room, and backyard. In the areas toured no immediate health, safety, or personal rights violations were observed. The home is very clean and residents stated they are happy with care. Elopement measures discussed to include not locking doors. LPA reviewed 3 resident files. Files are complete and well organized. LPA reviewed 2 staff files. Files are complete. Staff training requirements discussed. LPA requested the following documents to update the facility file: LIC 308- designee, Dementia addendum, Ins. cert. by 5/13/26 No deficiencies are being cited as a result of todays inspection. Type of visit: Case Management - Deficiencies
On 9/30/25, LPA Kevin Mknelly met with newly assigned administrator, Angela Chen. The purpose of the visit was to issue citations for violations found in the meeting of 9/29/25. This license is in the process of change of ownership. During the process the licensee failed to follow the following regulations: 87355( c) Criminal Record Clearance (c) A licensee or applicant for a license may request a transfer of a criminal record clearance. By transfering ownership and installing Angela Chen as administrator, the licensee failed to transfer their clearance. 87155(a)(7) Application for License (7) Name and address of owner of facility premises if applicant is leasing or renting. This requirement was not met based on statements that the licensee did not maintain a title orlease for their licensed property. 87211(g) Reporting Requirements (g) The licensee shall notify the Department, in writing, within thirty (30) days of the hiring of a new administrator. This requirement was not met based on statements that a new administrator has been in place for greater than 30 days without notice to CCLD. Deficiencies are noted on the following page. On September 29, 2025, a virtual office meeting was conducted via Teams, with Licensing Program Manager, Maribeth Senty and Licensing Program Analysts, Kevin Mknelly and Cassie Yang, was conducted with Administrator, Kevin Lee. Also in attendance was Maria Cucicea. The purpose of the meeting is to discuss the pending change of ownership. Items discussed and agreed to include: · The licensee shall provide written notice to the department and to each resident or his or her legal representative of the licensee's intent to change the use of the facility to a new licensee. · If the property is already sold and the transfer of the property has already been completed the licensee shall submit a lease agreement between the property owner and the current licensee (which may have a termination date of when/if a new license is granted). · Licensee will submit a designation of new administrator if applicable as well as a copy of the new administrator’s administrator certificate. · A new administrator or any new staff shall be on the current licensee’s staff roster. This can/ must be done by submitting a transfer request form of through Guardian. · Licensee will submit LIC 500s for the three homes under changes of ownership which include expected hours that the administrator will be present at each facility. · As the licensee you will need to provide CCL with copies of the 60 days' notices that were served to the residents and their responsible parties. · The licensee agrees licenses are not transferable; therefore, the buyer of a facility must apply for and obtain a new license from the Department before the ownership of the facility can be transferred. · The licensee is still accountable for the facility until the licensure has been approved. · As a reminder, licenses are not transferable; therefore, the buyer of a facility must apply for and obtain a new license from the Department before the ownership of the facility can be transferred. In the areas toured no immediate health, safety, or personal rights violations were observed. The home is very clean and residents appeared satisfied with care. LPA reviewed 3 resident files. Files are complete and well organized. LPA reviewed 2 staff files. Files are complete. One staff file needs recent CPR certificate in the personnel file. LPA and Maria discussed recent regulation changes- referred to updates on the departments web page and updated CARE inspection tool. On 8/22/24, Licensing Program Analyst (LPA) Kevin Mknelly arrived at the home and announced the reason for the visit. Administrator designee Maria Cucicea arrived to assist. LPA and Admin designee discussed the plan of correction for citation written on 8/1/24. Admin designee expressed that a refund was not due to R1's responsible party (RP). LPA and Admin designee discussed the accounting provided by all parties. Licensee will email RP an accounting of all expenses and payments received by to date 8/23/24. LPA will review the email summary and determine if further action is required. As a result of today's visit no additional citations are delivered at this time. Allegation investigated: Licensee violated admission agreement requirements Licensee failed to provide records requested
On 8/1/24, Licensing Program Analyst (LPA) Kevin Mknelly spoke to caregiver to deliver complaint findings for the above allegation. Caregiver notified Administrator. Designee, Audre Smith arrived to assist. LPA reviewed resident records, facility records and conducted extensive interviews. LPA finds that the allegations cited above are substantiated. Licensee violated admission agreement requirements- In review of records submitted to LPA Mknelly during the investigation it was found that the admission agreement in use by the licensee has not been submitted to and approved by the Department. The signed agreement, however, does identify the fees to be paid for R1’s stay at the home. A review of the fees paid for allowable expenses, the Department finds that a refund is owed to the estate of R1 which was not repaid within 15 days of R1’s passing. R1 was admitted on 3/2/24 and belongings moved out on 4/4/24 . Allowable expenses are the monthly expense for March, daily rate for April, ... report continued Substantiated cable fee and half of the pre-admission charge (as the agreement states half to be reimbursed for less than a 90 day stay). There is discrepancy between what R1’s responsible party says was paid for R1’s stay versus what the licensee’s accounting said was paid. The department does not determine the actual amount only that overpayment was made and a refund is due. The parties involved will seek to resolve the amount owed and seek other means to remediate any discrepancy. Records review and interview conducted also found that under CCR 87507 – Admission Agreement section (e), a copy shall be provided to the resident and/or responsible party at signing and section (g)(3)(H) a itemized monthly payment statement shall be provided to the resident and/or responsible party, the admission agreement nor the itemized statements were issued to R1’s responsible party promptly when requested. As a result of this investigation, LPA finds allegation to be (S) Substantiated - A finding that the complaint is Substantiated means that the allegation is valid because the preponderance of the evidence standard has been met. The following deficiencies were cited on 9099-D, per Title 22 Regulations, Division 6. (A)This poses an immediate Health and Safety risk to clients/residents in care. (B) This poses a potential Health and Safety risk, or personal rights violation, to clients/residents in care. Report reviewed with . Copy of this report and appeal rights provided. Type of visit: Required - 1 Year
Licensing Program Analyst (LPA) Kevin Mknelly arrived at the facility unannounced on 5/7/24 to conduct a Annual Inspection utilizing the CARE inspection tool. LPA met with staff and explained the purpose of the visit. LPA toured the interior and exterior of the facility together with staff to ensure health and safety of residents in care. Areas toured include but are not limited to: common areas, resident bedrooms, bathroom, kitchen, laundry room, and backyard. In the areas toured no immediate health, safety, or personal rights violations were observed. The home is very clean and residents appeared satisfied with care. LPA reviewed 5 resident files. Files are complete and well organized. LPA reviewed 2 staff files. Files are complete. LPA and staff discussed several issues. Advisories provided. No deficiencies are being cited as a result of todays inspection.
