Allegation investigated: Staff did not ensure resident was taken back to the doctors for follow up visit

Licensing Program Analyst (LPA) Jason Lund arrived unannounced to complete a complaint investigation regarding the above allegations. LPA Lund met with Caregiver Romeo Apuya Jr and explained the reason for the visit. Census: 2 Staff did not ensure resident was taken back to the doctors for follow up visit- LPA Lund interviewed Staff, and witness. Based on interviews with Staff and Witness Resident (R1) missed a doctor’s appointment due the driver not being able to make the appointment. Facility Staff stated that they failed to make another appointment for R1. Based on interviews with Staff and Witness, on the information provided, it clear that staff did not ensure resident was taken back to the doctors for follow up visit, therefore the allegation was deemed SUBSTANTIATED. Substantiated As a result of this investigation, this LPA found the allegations to be SUBSTANTIATED - A finding that the complaint was Substantiated meant that the allegation was valid because the preponderance of the evidence standard had been met. Per the California Code of Regulations, Title 22, Division 6, Chapter 6, deficiencies were observed or cited and noted on LIC 809D Based on facility paperwork, observation, interviews with staff and witnesses on the information provided, it was unclear if staff are not meeting resident's bathing needs, the allegation was deemed UNSUBSTANTIATED. As a result of this investigation, this Department finds the allegations to be UNSUBSTANTIATED. A complaint allegation finding of Unsubstantiated means that although the allegations may have happened or is valid, there is not preponderance of the evidence to prove that the alleged violations occurred. On January 09, 2025, at 1:00 PM, Licensing Program Analyst (LPA) Avelina Martinez made an unannounced visit to this facility to conduct an annual required inspection. LPA Martinez met with Romeo Apuya and explained the purpose of today's visit. LPA inspected the physical plant including but not limited to the kitchen, dining room, resident bedrooms; resident bathrooms, laundry room, activity room, and outside courtyards of the facility to ensure compliance with Title 22 regulations. Administrator holds current certificate and expires on November 01, 2026. The facility is licensed for 6 non-ambulatory residents, and has a hospice waiver for 1 resident. There are currently 4 residents who reside at this facility. There are no residents on hospice. The LPA Martinez toured the facility with Romeo Apuya on January 09, 2026, at 2:30 PM. LPA Martinez reviewed four resident files and four staff files. The files were maintained and current. LPA Martinez reviewed two centrally stored medication and destruction records, and LPA Martinez observed the records to complete and maintained. The facility has a emergency disaster plan, and the last fire drill was conducted on January 01, 2026. The facility has an infection control plan. The facility temperature measured at 71 degrees, and the water temperature measured at 105 degrees. Smoke detectors are in good repair. The facility common areas, bedrooms, and bathroom are furnished and sanitary. The exterior of the facility is clear of debris and sanitary. The facility has an adequate food supply. Type of visit: Case Management - Deficiencies

On 5/15/25 Licensing Program Analyst (LPA) Holly Williams conducted a case management inspection to address a family member (FM) living in the facility. LPA met with Romeo Apuya and together discussed the report. LPA asked Apuya to call the licensee Mary Jane Apuya and they gave permission for Romeo Apuya to sign this report. LPA conducted an inspection to check to see if the Family Member (FM) was still living in the dining room and the FM was not. Upon touring the home at 9:30 AM LPA observed cleaning supplies and laundry detergents that were unlocked and accessible to the residents in the laundry room and laundry room hallway. The following deficiency was observed and cited on the following LIC 809-D pursuant to Title 22 Rules and Regulations, Health and Safety Codes. Licensing Program Analyst (LPA) Holly Williams arrived unannounced to conduct an annual inspection. LPA Williams met with the facility administrator on the phone Mary Jane Apuya (MJ) and explained the purpose of the visit. MJ said that Romeo Apuya Junior can sign for her. LPA Williams reviewed three resident files (R1-R3) and staff files (S1). LPA Williams toured the facility with Romeo Apuya Jr. and inspected common areas, the kitchen, bedrooms, bathrooms, and backyard areas. Furniture and furnishings were sufficient to meet the needs of residents. The facility temperature was 70 degrees Fahrenheit, which is within the required range of 68 and 85 degrees. The facility's water temperature measured 121.6 degrees Fahrenheit, which is not within the required range of 105 and 120 degrees. LPA Williams asked Apuya Jr. who is sleeping on the couch in the dining room because there was bedding and it looked slept in and Apuya Jr. stated his family member (FM). LPA Williams ask if the FM lived at the facility and Apuya Jr. said yes. LPA Williams observed first aid supplies, a fully-charged and up-to-date fire extinguisher, and working carbon monoxide/smoke detectors. LPA Williams observed a minimum 2-day supply of perishable food and a minimum 7-day supply of nonperishable food. LPA Williams observed a locked cabinet for the storage of medication. LPA Williams observed locked cabinets for the storage of cleaning solutions and knives. LPA Williams interviewed one staff member (S1) and one resident (R1). This facility is being cited per 22 CCR Section 87303(e) and 87307(a). LPA met with Mary Jane Apuya and explained the purpose of today's visit. LPA inspected the physical plant including but not limited to the kitchen, dining room, resident bedrooms; resident bathrooms, laundry room, activity room, and outside courtyard of the facility to ensure compliance with Title 22 regulations. LPA toured the facility with Mary Jane Apuya on 12/20/2023 at 9:21am. Administrator holds current certificate and expires on 11/01/2024. The facility is licensed for 6 non-ambulatory residents, and has a hospice waiver for 1 resident. There are currently 4 residents who reside at this facility. There are no residents on hospice. LPA requested and received current facility LIC500. The facility has an infection control plan in place. The facility has one main screening entry point, and furniture is spaced 6 feet apart. The facility smoke and carbon detectors are in good repair. The facility fire extinguisher is in good repair. The facility has an adequate food supply and has emergency food and water kit. The facility has a first aid kit. Water temperature is 110 degrees. Facility temperature is 73 degrees. The facility has a locked medication cabinet, and the facility has an updated Centrally Stored Medication and Destruction record for each resident in each resident file. 4 resident and 3 staff files have all required documents. The facility also has the required postings through out the facility. The facility is clean and sanitary. The exterior emergency exits are clear of debris. Per California Code of Regulations (CCRs) - Title 22, no deficiencies cited.
