Allegation investigated: Resident was sexually assaulted due to staff neglect or abuse Resident was physically confined

On 9/16/2026, Licensing Program Analyst (LPA) Valerie Flores conducted an unannounced visit to the facility for the purpose of delivering the findings into the allegations listed above. LPA Flores met with Administrator Magdalina Gurau and explained the purpose of the visit. The investigation is summarized as follows: On 5/18/2026, Community Care Licensing (CCL) received information alleging Resident #1 (R1) was sexually assualted due to staff neglect or abuse. An interview with Administrator reports that they were not aware of the incident being alleged and declined that the incident ever occurred. An interview with R1's responsible person reports that they are aware of the allegations being made but that they are false. R1's responsible person reports that they believed R1 was experiencing an altered mental stated and was making false claims of being sexually abused. LPA Flores attempted to interview R1 but the interview was unsuccessful due to R1's cognitive abilities. Interviews with (3) three additional residents whose bedrooms... (Continue to LIC9099C...) Unsubstantiated (Continuation from LIC9099) ...are in close proximity of R1's bedroom, declined the allegation to be true. Resident interviews report that they have never experienced a time when an unknown individual entered into the facility and sexually abuse them nor have witnessed another resident being sexually abused. Additional information alleged R1 was physically confined in a box. An interview with Administrator reports that they were not aware of the incident being alleged and declined that the incident ever occurred. An interview with R1's responsible person reports the allegation to be false. R1's responsible person stated that R1 was reporting to R1's responsible person that R1 was placed in a small box. R1's responsible person gestured with their hand a box that would be (20) twenty inches inches in all diameters. R1's responsible person further explained that it would be physically impossible to place any adult persons in a small box of that size and believes R1 to be having delusions. Resident interviews report that they have never observed R1 nor any other resident being physically confined. LPA Flores attempted to interview R1 but the interview was unsuccessful due to R1's cognitive abilities. Therefore, the allegations of resident was sexually assaulted due to staff neglect or abuse and resident was physically confined is deemed unsubstantiated. A finding that the complaint is UNSUBSTANTIATED means the preponderance of the evidence has not been met. On July 16, 2026, Licensing Program Analyst (LPA), Jarred Torres, arrived at the facility unannounced to conduct an annual inspection, and met with Licensee, Casandra Gurau. A facility file review was conducted at the regional office, and additional records were requested and reviewed at the facility. Their files were stored in a secure location. The facility is licensed for twelve residents and was operating at a census of ten. LPA toured the facility along with Administrator (AR), Magdalina Gurau, and made observations pertaining to the annual inspection. LPA inspected the facility inside and outside. There were no obstructions to the indoor and outdoor passageways at the time of this visit. During the tour, LPA observed the facility's phone to be operational. The facility's phone number is 951-588-6533. LPA observed the residents' bedrooms to be equipped with the required furniture as stated in Tittle 22 of the California Code of Regulations (CCR). The furniture in all areas of the facility was observed to be in good condition. The facility's appliances were observed to be operational at the time of this visit. Required postings regarding safety, personal rights, and emergency exits were posted in the home. Sharp items were kept locked and inaccessible to residents in care. The facility's cooling and heating system is operational and the air temperature was at 77 degrees Fahrenheit (F) and the hot water was measured at 107 degrees F. Continued on LIC 809-C... LPA observed the medications to be locked and inaccessible to the residents in care. The medication supply was sufficient for their current census, and there were no discrepancies with the centrally stored medications. In the kitchen, the food supply of non-perishable and perishable foods consisted of, but not limited to, bread, milk, vegetables, soup, juice, and meat. The facility goes grocery shopping two to three times each week to maintain an appropriate food supply for the residents. The facility has a designated area for storing activity supplies, and activities are conducted inside and outdoors. Telephone numbers and floor plans were posted in the facility. Client files and staff files were reviewed and no deficiencies were observed. The files were securely stored. The administrator had a valid administrator's certificate on file. LPA reviewed the emergency disaster plan and fire clearance. The last emergency drill was on July 3, 2026. The fire alarms and carbon monoxide detectors were tested and operational. The fire extinguishers were in good condition and were inspected on July 1, 2026. The emergency disaster plan meets the department's standards. LPA inspected the bathrooms and observed the hand washing stations to be stocked with soaps, bath tissue, and single-use hand towels. Furthermore, the bathrooms are free of dust and debris. Additionally, the facility had an approved infection control plan in their files. During this annual inspection, LPA did not observe any health, safety, or personal rights risks to clients in care. Licensing Program Analyst (LPA), Armando Perez made an unannounced visit to the facility for the purpose of conducting a required annual inspection. The LPA was granted entry by staff to conduct the inspection and met with administrator, Magdalina Gurau. The LPA informed the Administrator of the purpose for the visit. The inspection included the following: LPA toured the facility inside and outside. LPA observed the facility to be clean and in good repair. The facility consists of nine (9) bedrooms, eight (8) bathrooms, a kitchen and dinning area, a living room area, a garage and laundry room, and a front patio and yard with sufficient seating and space for activities. The home is maintained at a comfortable temperature for the clients. Lighting is sufficient for safety and comfort. Water temperature measured within regulation. Laundry facilities and a locked cabinet is present for storing laundry soap and other chemicals. All outdoor and indoor passageways are free of obstruction. Emergency lighting is available. There is a telephone working at this location. The LIC 610, emergency disaster plan is maintained. There are no firearms at this home and no bodies of water observed. LPA reviewed client records. nine (9) records were reviewed. LPA reviewed for identification and emergency information, admission agreement, medical assessment, and TB test results, needs and service plans, placement, functional assessment, centrally stored medication/destruction records, safeguard for personal property/valuables, and personal rights notification. LPA observed client records to be available and complete. LPA reviewed employee records- four (4) records were reviewed. LPA reviewed employee records for first aid certification, criminal record clearance or an exemption, health screening and TB test results, employee rights, training verification, and current administrator certification; expiration date 03/21/2027. LPA observed personnel records to be available and complete. Continued on LIC 809-C. LPA observed facility kitchen had the ability to prepare food in clean environment and possessed equipment in good working condition. Food supply meets the requirement of one (1) week supply of nonperishable and two (2) day supply of perishables. Emergency food and water supply is present. There is a locked location for chemicals and sharps in the kitchen. Medications are centrally stored. There is a locked cart allocated for medication storage. Centrally stored medication and destruction logs are maintained. Medications reviewed appear to have been dispensed accurately. LPA made observation throughout the inspection process to assess if the facility remains in conformity with the State Fire Marshall regulations. Smoke detectors and carbon monoxide detectors were tested and found to be operational. Fire extinguishers was serviced on 07/07/2025. Fire drills are conducted quarterly at the facility with the last drill on 05/20/2025. Based on the information received during this visit today in the areas reviewed, there are no deficiencies that are being cited per Title 22, Division 6 of The California Code of Regulations. Licensing Program Analyst (LPA), Stephanie Martinez, conducted a required annual inspection to the facility. The LPA was allowed entrance into the facility and met with Administrator, Magdalina Gurau. The LPA informed the Administrator of the purpose for the visit. The inspection included the following: Physical Plant: The facility consists of eight (8) resident bedrooms, seven (7) bathrooms, three (3) storage areas, two kitchen and dinning areas, one (1) living space, a laundry room, and a patio and yard with sufficient seating and space for activities. There are no bodies of water located on the property. According to Administrator Gurau, no weapons are stored in the home. The facility is being maintained at a comfortable temperature. All outdoor and indoor passageways are kept free of obstruction and are free of debris and other trash. There are grab bars for each toilet, bathtub and shower used by residents. Resident showers have non-skid mats or strips present. The carbon monoxide device was tested by the Administrator and was observed to be in operating condition. The smoke detectors are currently being monitored by Troy Alarm and was the last inspection on file was from 12/22/2023. The home was kept exceptionally clean, organized and free of any odors. Food Service: There is a minimum of 2 days supply of perishable foods and 1 week's supply of non-perishable foods available. Sufficient dinning supplies were available for residents in care. A variety of food was available and stored in a safe and healthful manner. Record Review: All staff were observed to have appropriate fingerprint clearances. LPA did not observe any excluded individuals on the premises at time of visit. Staff responsible for direct care and supervision have current first aid and CPR training. Dementia care training was observed to be available and complete. The facility was not operating beyond the conditions specified on the license. The facility currently has an approved Hospice Waiver for nine (9) residents and there are currently three residents in care receiving hospice services. There is a disaster and mass casualty plan in place. Proof of emergency drills were observed on file. All records were observed to be well organized and safely secured. Medication Review: The LPA inspected resident medications. Medications were observed to be well organized, appropriately labeled and inaccessible to unauthorized individuals. An exit interview was conducted with Administrator Gurau in which this report was reviewed and a copy was provided.
