At approximately 10:00AM, Licensing Program Analyst (LPA) Chris Arnhold arrived at this facility unannounced, to conduct an investigation into the above allegation. LPA met with Facility Manager Theresa Ilagan, toured the facility and reviewed documents. LPA spoke with Administrator Rose Mahawar via telephone during this visit. Based on records reviewed, Facility did not have documentation of 5 of 8 staff required training hours completed. LPA discussed the requirements for staff training hours with Administrator and provided a copy of regulation. All staff have received their training since the last visit. Based on the Departments investigation, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. Licensing Program Analyst Leibert arrived unannounced for the purpose of delivering findings on this complaint. LPA met with TJ Ilagan and discussed the disposition. Complainant has alleged that R1 stated that a staff person (S1) physically attacked R1 over a 3 day period. The resulting investigation has included a review of pertinent documents and taking of statements from witnesses and involved parties. The following determinations are made: R1 has a medical diagnosis that makes R1's testimony unreliable; Staff who were present at the time of the 7/2/23 incident recall R1 in an agitated state, throwing furniture and destroying facility property; S1 held R1 in order to avoid injury to other residents and to R1until assistance arrived; During a subsequent interview, R1 stated that S1 did not hit R1 but did restrain R1 and did not report any other incidents of alleged physical abuse. During the course of this investigation, this Department has interviewed witnesses and obtained and reviewed documents, as well as made site visits to the facility. During the course of this investigation, statements were taken from staff and documents were obtained and reviewed. Attempts to contact the Complainant in order to obtain a statement and clarify information was unsuccessful. Both phone numbers listed in the case file are not valid, on have been disconnected and the other is not a number for the Complainant. A letter was sent to the Complainant at the listed address requesting contact on April 17, 2023 but no response has been received. Facility staff deny the allegations and have indicated the paramedics appeared at the facility unannounced in order to transfer the complaint subject to another facility. Staff indicate the delay in preparing the subject for transport resulted from the lack of notification of the date and time of transport. During the course of this investigation, this Department has reviewed documents and taken witness statements. The following determinations are made: R1 was admitted to a medical facility on 03/25/2025; On or about 03/27/2023, R1 was medically cleared for release and R1's care facility was notified; On 03/28/2023, in conversation with medical social worker, W1, care facility staff indicated refusal to accept R1 back into the care facility and indicated that R1 was evicted from the care facility; R1 remained in the medical facility until 04/04/2023, at which time R1 was placed in an alternate care facility; Care facility has failed to provide proof of filing an unlawful detainer/court order in compliance with H&S 1569.683(a)(4).
