Allegation investigated: Uncleared staff providing care to residents.

On 12/30/2025, Licensing Program Analyst (LPA) Arvin Villanueva arrived unannounced at this facility to initiate the complaint investigation. LPA met with staff on duty (S1) and notified the Administrator. The Administrator, Merly Agula (AD) arrived shortly after. LPA explained the nature of this complaint. The details of the complaint alleging that the Administrator is allowing an individual t provide care to the residents and under a false name and without proper background clearance. Throughout this investigation, LPA conducted observation, interviews and record reviews. LPA observed staff, S2, a maintenance worker, interacting with residents during the visit. LPA also observed a red van parked in the facility driveway. Allegation investigated: Facility staff are not qualified to care for residents

Licensing Program Analyst (LP) Victoria Brown arrived unannounced to conclude the investigation of the above mentioned allegation on 6/26/24 at 8:45am. LPA met with Merly Aguda and stated the purpose of the visit. LPA conducted an interview with Administrator during this visit. Regarding allegation, "Facility staff are not qualified to care for residents," LPA observed during interviews on 3/29/24 of staff #2 and residents 1-7 that staff did seek lift assistance from other resident when R1 fell in the bedroom. In addition, S2 stated that English is the second language and Taglog is the first but S2 understands the residents and the residents understand S2 as well. During this visit LPA observed residents communicating with S2 in English to each other. Based on the interviews, and admittance by S2 the allegation is deemed substantiated. Licensing Program Analyst (LPA) Christina Valerio and LPA Jamie Ivey Canady arrived at the facility unannouced to deliever complaint investigation findings. LPAs met with Administrator Merly Aguda and explained the purpose of the visit. The Department has determined the following as it relates to the complaint allegation: Unlawful Eviction On 12/10/2021, the department recieved notication regarding a eviction notice for Resident 1 (R1). The department approved the eviction notice based on R1 needing a higher level of care that the facility could provide. Administrator Merly stated R1's responsible party was notified verbally regarding the eviction prior to the department approving the eviction. Administrator Merly stated she extended the discharge date to Febraury 2022 to allow time to find placement. On Feburary 2, 2022, R1 discharged to live with family. Continues on LIC 9099 - C..
