On 04/20/23 at 08:40 a.m., Licensing Program Analyst (LPA) Jewel Baptiste conducted an unannounced complaint visit to the facility. Upon arrival LPA met with Ana Giron (Administrator) and explained the purpose of the visit. Prior to the visit LPA reviewed a copy of the eviction noticed dated April 13, 2023, for Resident #1 and Resident #2. LPA also received an Unusual Incident Report describing a physical altercation between Resident #1 and Resident #2 dated 4/9/2023 with the eviction notice. The Residents received a copy of the notice April 13, 2023. During today’s visit LPA obtained resident/ staff roster, admissions agreement for R1 and R2, House Rules for R1 and R2 and reviewed the camera and observed R1 and R2 physical altercation. LPA also interviewed: Administrator and a total of two (2) staff who shall be referred to as S1, and S2. LPA interviewed a total of 6 residents who shall be referred to as: R1 through R6. Licensing Program Analyst (LPA) V. Maldonado made a subsequent visit at the facility regarding the above-mentioned allegation and to deliver findings. LPA Maldonado met with administrator Ana Giron and explained the purpose of the visit. On 01/08/21, LPA Kruz Long made an initial virtual complaint visit due to the situation surrounding the Coronavirus Disease 2019 (COVID-19), and to implement mitigation measures. During the visit, LPA Long requested a copy of the Resident/Staff, Resident #1's signed payment agreement and interviewed Staff #1. During the visit conducted on 08/17/22, LPA Maldonado requested a copy of resident and staff roster, and the following documents for Residents# 1- #6 (R1-R6): Facesheet, Phsycian's Report, Appraisal, payment agreement for residents who receive personal and incidental (P&I) funds, and Record of Resident's Safefguarded Cash Resources for 2020. Licensing Program Analyst (LPA) David Sicairos conducted an unannounced subsequent complaint visit regarding the above stated allegations. LPA met with Assistant Administrator Erika Becerra and explained the reason for the visit. The investigation consisted of the following: during the initial visit conducted on 05/05/22, LPA interviewed the Administrator and obtained copies of Resident & Staff Rosters and conducted a tour of facility including the common areas. LPA also obtained copies from Resident #1 (R1) file such as Resident Appraisal, Physician's Report, Identification and Emergency Information Sheet, Hospital Discharge Paperwork, and Incident Report. During today's visit, LPA interviewed Staff #1 - Staff #3, and Resident #1 - Resident #6. The investigation revealed the following: in regards to the allegation "resident sustained an unwitnessed fall resulting in injury", it is alleged that R1 had an unwitnessed fall that resulted in a humerus fracture.
