Licensing Program Analyst (LPA) Arian Golbakhsh conducted an unannounced, required Annual Inspection. The facility file and personnel report was reviewed prior to the visit. LPA was welcomed by, identified themselves to, and discussed the purpose of the visit to Caregivers Margarita Swindle and Jonel Morales. Licensee/Administrator Bella Amor Morales arrived later during the visit. The facility's license shows a maximum capacity of six (6) non-ambulatory residents, five (5) of which may be bedridden. All bedrooms except bedroom #5 are approved for bedridden. Additionally, the facility is approved for six (6) hospice waivers. During today’s inspection there were six (6) residents in care, with three (3) currently on hospice. LPA and Administrator Morales toured the interior and exterior of the facility and inspected each room. The facility was clean, sanitary, and in good repair. Pathways were free of obstruction and slip hazards. Client bedrooms contained the required furnishings. Doors, windows, screens, toilets, and showers were in working order. Hot water temperature at taps accessible to clients were all compliant: one common bathroom sink was 105F. Extra linens and hygiene supplies were present, as well as Personal Protective Equipment. The facility had sufficient space and equipment to facilitate dining, laundry, visitation, meetings, and client activities. The facility contained at least two (2) days of perishable food, and at least seven (7) days non-perishable food, all safely stored. Cooking, dining equipment, and utensils were present. Medications were labeled, as required, and stored in locked areas. No pools or bodies of water exist on the premises. Per Administrator Morales, no firearms or ammunition are kept at the facility. Smoke and carbon monoxide detectors, emergency lighting, and facility telephone were all in working order. Fire extinguishers were serviced within the last 12 months, dated for February 2026. Per file review and interview, the facility had not conducted any staff emergency drills in the last year. A Type B citation was issued for not conducting emergency drills as required per California Health and Safety Code. First aid kits were complete and readily accessible. Required licensing postings were observed in visible areas of the facility. LPA interviewed one (1) staff and one (1) client, and interviews did not reveal any licensing or regulatory concerns. LPA reviewed facility records. The files reviewed by LPA contained most required documents. While reviewing resident records, LPA noted that the copies of resident personal rights retained in their files were blank, aside from one. A Technical Violation (TV) was issued. Confidential records were stored in locked areas. One (1) deficiency was cited during the inspection and one Technical Violation (TV). Allegation investigated: Lack of supervision led to resident AWOL.

Licensing Program Analyst (LPA) Nacole Patterson conducted an unannounced visit to deliver findings regarding the above complaint allegation. LPA introduced herself and disclosed the purpose of the visit to Administrator Bella Morales. On 10/18/23 it was alleged that lack of supervision led to resident (R1) AWOL. The Department’s investigation consisted of unannounced facility visits, review of facility and outside source records, interviews with facility staff, residents, outside sources, and LPA direct observations. Staff interview revealed that during the timeframe of the incident, the Licensee had systems in place for resident safety and supervision such as frequent resident checks and alarmed doors. Staff interviews revealed that R1 did not have known history of exit-seeking behaviors or wandering at night. (Continued on LIC9099 p.2) Unsubstantiated (Continued from LIC9099 p.1) Staff members interviewed consistently recited the procedures put in place for supervision and care of residents. Staff interview further revealed that R1's behavior was likely pre-meditated, as R1 had re-dressed themselves in the middle of the night, disarmed their bedroom alarm, and climbed over the backyard fence to exit the facility without staff knowledge. Outside source interview revealed no concerns regarding the Licensee's care and supervision of R1. One outside source informed that the incident was a new behavior for R1, triggered by a visitation pattern disruption. A second outside source expressed no observations or concerns regarding resident supervision by the Licensee. Records review revealed that R1 suffered from a cognitive impairment but was able to leave the facility without assistance. While records showed that R1 experienced confusion and disorientation, no records were found to show that R1 had a history of exit-seeking behaviors. During an unannounced facility visit, LPA directly observed working, in-tact alarms on all exit doors at the facility, including in resident rooms. Due to their baseline memory loss, R1 was unable to participate as a reliable historian/interviewee about the incident. Based on interviews, direct LPA observations and records review, the investigation did not yield sufficient evidence to conclude that lack of supervision led to resident AWOL. Based upon the foregoing, the allegation is unsubstantiated. This finding means that although the allegation may have happened or may be valid, there is not a preponderance of the evidence to prove that the alleged violation occurred."
