Type of visit: Required - 1 Year

This unannounced inspection is being conducted by Licensing Program Analyst (LPA) Sean Haddad for the purpose of conducting a Required – 1 Year Inspection. LPA met with Administrator (AD) Thomas Trice and discussed the purpose of the inspection. LPA reviewed Infection Control requirements. At about 10:30AM, LPA and AD conducted a tour of the inside and outside of the facility, common areas, resident rooms, kitchen, and garage and observed the following: Structure: facility is a 7-bedroom, 2-bathroom, one-story house with an attached garage that is used for storage. There is a back yard with a patio cover for the residents. LPA and AD observed 2 staff and 6 residents present at the facility. Resident Bedrooms: the 6 resident bedrooms are spacious and will easily accommodate the residents’ furnishings. Furniture for each resident bedroom inspected. Staff Bedrooms: LPA inspected the one staff bedroom. Bathrooms: the bathrooms were clean, faucets and toilets were operational. Water temperature: tested at 106.5 degrees F in the resident bathroom. Linens & Hygiene Supplies: new linens and fully stocked linen closets were observed. Emergency Phone Numbers, Exit Plan & Menu: reviewed. Food Service: LPA observed the facility has a 2-day supply of perishables and a 7-day supply of non-perishable food is available as required by regulations. Carbon Monoxide, Smoke Detectors, Fire Extinguisher: observed and tested. Appliances: stove burners, microwave, washer, and dryer inspected. Knives: observed locked in the kitchen. Toxins: observed locked in the laundry room. Medication cabinet: observed to be locked. First-Aid Kit and Activity Supplies: observed and available. Facility’s licensing fees have not been paid but are not yet past due. At about 8:00AM, LPA reviewed 6 resident files and 3 staff files, interviewed 2 residents and 2 staff, and inspected medications for 6 residents. Facility does not handle resident money. There were no deficiencies observed in the areas inspected. Based on the observations made during today’s inspection, no deficiencies are being cited per Title 22 Division 6 of the California Code of Regulations. Allegation investigated: Resident sustained a fall resulting in a fractured hip, and the staff did not seek medical attention in a timely manner.

Licensing Program Analyst (LPA) Ruth Martinez visited the facility to deliver findings for the investigation into the above identified complaint allegation. LPA arrived at facility and was greeted at the door by staff and granted entry. LPA spoke with Thomas Trice, Administrator and explained the purpose of the visit. The complaint was investigated by the Department. Findings are based upon this investigation which included interviews with 3 staff, a resident and 2 witnesses and the following records review: Providence St. Jude Hospital dated September 10, 2024, United Integrity Home Health dated October 4, 2024, and resident’s facility file. It is alleged resident sustained a fall resulting in a fractured hip, and the staff did not seek medical attention in a timely manner. Interview with staff (S1 & S2) stated on July 13, 2024 around 4:00pm resident (R1) Continued on LIC9099-C Unsubstantiated was in their room sitting in their recliner watching television. S1 and S2 were preparing for dinner when they heard a scream coming from R1’s bedroom. Staff immediately rushed to R1’s bedroom and found R1 on the floor with their head facing the bedroom doorway. S2 assessed R1 for any injuries and noted there were no visible signs of bruising. R1 stated they were fine and had no pain. Staff suggested for R1 to go to hospital for further evaluation, however R1 declined further medical attention. Staff monitored R1 in case they didn’t have any delayed pain. On the morning of July 14, 2024, around 8:45am staff checked in on R1 and R1 complained of pain to their upper left thighs. R1’s POA decided to call 911 to transfer R1 to the hospital at that time. Record review revealed that united Home Health was notified of the fall and due to R1 refusing further medical care doctor ordered mobile x-rays to be done. Records from Providence St. Jude revealed when R1 was picked up by medics and when arrived at hospital there was no visible bruising or deformity on left hip. Based on the information gathered during the investigation, there was not enough evidence to support the allegation. Based on the information mentioned above, the Department is unable to ascertain if the allegations occurred as reported. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove or refute the alleged violation occurred; therefore, this allegation is deemed Unsubstantiated. At about 2:15PM, LPA and S1 conducted a tour of the inside and outside of the facility, common areas, resident rooms, kitchen, and garage and observed the following: Structure: facility is a 7-bedroom, 2-bathroom, one-story house with an attached garage that is used for storage. There is a back yard with a patio cover for the residents. LPA observed 2 staff and 6 residents present at the facility in addition to AD. Resident Bedrooms: the 6 resident bedrooms are spacious and will easily accommodate the residents’ furnishings. Furniture for each resident bedroom inspected. Staff Bedrooms: LPA inspected the staff bedroom. Bathrooms: the bathrooms were clean, faucets and toilets were operational. Water temperature: tested between 110 and 112 degrees F in the 2 resident bathrooms. Linens & Hygiene Supplies: new linens and fully stocked linen closets were observed. Emergency Phone Numbers, Exit Plan & Menu: reviewed. Food Service: LPA observed the facility has a 2-day supply of perishables and a 7-day supply of non-perishable food is available as required by regulations. Carbon Monoxide, Smoke Detectors, Fire Extinguisher: observed and tested. Appliances: stove burners, microwave, washer, and dryer inspected. Knives: observed locked in the kitchen. Toxins: observed locked in the laundry room. Medication cabinet: observed to be locked. First-Aid Kit and Activity Supplies: observed and available. Facility’s licensing fees are not yet due. At about 3:00PM, LPA reviewed 6 resident files and 2 staff files, interviewed 2 residents and 2 staff, and inspected medications for 6 residents. Facility does not handle resident money. During the inspection, LPA and AD observed the following: based on Guardian records, S1 is background cleared but is not associated to the facility; based on documents, the licensee did not ensure 2 out of 6 residents had signed admission agreements using this facility's admission agreement; and based on documents and observation, R1 has a full bedrail but is not on hospice. Based on the observations made during today’s inspection, deficiencies are being cited per Title 22 Division 6 of the California Code of Regulations. See LIC809D. Food Service: LPA observed the facility has a 2-day supply of perishables and a 7-day supply of non-perishable food is available as required by regulations. At about 1:45PM, LPA reviewed 6 resident files and 3 staff files, interviewed 4 residents and 3 staff, and inspected medications for 6 residents. Facility does not handle resident money. During the inspection, LPA and AD observed the following: based on observation, the licensee did not ensure supplements and Tylenol were inaccessible to residents in the non-lockable staff bedroom. During the inspection, the licensee secured these items and LPA confirmed. Based on the observations made during today’s inspection, deficiencies are being cited per Title 22 Division 6 of the California Code of Regulations.
