Licensing Program Analyst (LPA) Brian Phillips conducted a subsequent complaint visit to deliver final findings for the above allegations. During today’s visit, LPA Phillips met with Executive Director/Administrator Brian McCague and explained the reason for the visit. On the allegation: Due to neglect, resident sustained injury while in care. It is alleged that Resident #1 (R1) was found on their bedroom floor with blood around their head. The allegation states that staff suspect that the resident sustained an unwitnessed fall but were unable to explained what really happened. On 05/25/2023, Licensing Agency received an Unusual Injury/Incident Report from the facility that stated R1’s floor sensor/mat alarm was triggered at 12:25a.m. and R1 was found lying on their right side next to their bed with a bloody gash on their head. LPA arrived at the facility and announced the purpose of the visit. LPA met with Therese Brown, Director of Health Services. On the allegation: Residents are left in soiled diapers for an extended amount of time. It is alleged that residents have been observed walking around the facility with diapers full of urine and have also been left in soiled diapers overnight. On 04/26/2023, LPA interviewed staff members and residents in the facility. No staff member nor resident confirmed the allegation. Residents interviewed stated they were not left in a soiled state for a long period of time, and staff help when needed. LPA arrived at the facility at approximately 11:30am and announced the purpose of the visit. LPAs met with Therese Brown, Senior Director of Health Services and Glynn Caberte, Chief Financial Officer.During the visit, LPA conducted in-person interviews on 2/13/2023 from 9:15am through 11:50am and obtained copies of documents pertaining to the investigation. LPA conducted additional interviews with responsible parties and visitors 3/20/2023 from 9:15am to 11am, and responsible party on 3/23/2023 at 9:00am. On the allegation: Staff is financially abusing residents in care. It was alleged that Staff 1 (S1) was financially abusing Resident 1 (R1) and Resident 2 (R2). Licensing Program Analysts (LPAs) Olson and Cortez conducted an initial complaint visit to initiate the investigation. LPAs met with Administrator, Brian McCague, and explained the reason for the visit. On the allegation: Uncleared staff is working at facility. It was alleged that Staff 1 (S1) was working at the facility without fingerprint clearance, starting in December 2021. On 9/21/2022, LPA Kontilis conducted a case management visit to confirm an excluded staff was not present or working at the facility. During that visit, LPA Kontilis reviewed the facility fingerprint clearance roster and determined additional staff were working in the facility without fingerprint clearance, including S1. LPA Kontilis cited for fingerprint clearance on 9/21/2022 and issued a civil penalty. S1 was removed from the facility schedule on 09/21/2022.uintil fingerprint clearance is obtained.
