On 3/13/2025, Licensing Program Analyst (LPA) John Calandra met with Monica Ceron-Tapia, Executive Director for this conclusionary complaint inspection. On 11/27/2024, LPA conducted initial complaint inspection. Information gathered indicated the allegations may have occurred in an area not licensed by our agency. LPA Calandra later gathered more information regarding the above allegations regarding physical plant concerns in the facility. The resident (R1) in this complaint no longer resides at the facility. LPA Calandra has been unable to get any further information. Based on information from facility, it was determined R1 resided in a portion of the facility not licensed by our agency. Allegation investigated: Resident was left unattended without assistance for an extended period

On this day Licensing Program Analysts (LPA) Jaime Vado and Grace conducted an unannounced complaint investigation visit. LPAs met with the administrator Monica Tapia and explained the purpose of today's visit. During today's investigation it was discvered that the resident in question resides in independent living. LPAs reveiwed the file of the resident and observed the residency agreement the resident has with the facility. According to the file and agreement there is no care plan due to the resident being in independent living. The resident does receive home helath services due to a recent surgery where they come every week at least twice. This allegation is unfounded. This agency has investigated the complaint alleging, "Resident was left unattended without assistance for an extended period". We have found that the complaint was unfounded, meaning that the allegation was false, could not have happened and/or is without a reasonable basis. On this day Licensing Program Analyst (LPA) Jaime Vado conducted an unannounced complaint inspection visit in order to deliver the findings regarding the allegations received. LPA met with administrator Monica Tapia and explained the purpose of today's visit. During the investigation LPA conducted interviews, made observtions, and reviewed pertinent documents. Staffing is observed as in place. Interviews conducted at random with residents did not result in statements leading to staff not assisting timely. R1 does require double assist but with specific items only that is outlined as a double assist according to the care plan. The double assist is not needed at all times. Staff interviewed also did not have much knowledge of the situation as they were not present at the time the allegations were made. LPA discussed and advised on the use of staffing agencies if needed. On this day, Licesnsing Program Analyst (LPA) Jaime Vado conducted an unannounced complaint investigation visit in order to deliver findings of the allegation received. LPA met with administrator Monica Tapia and explained the purpose of today's visit. During the investigation LPA conducted interviews and reviewed documents related to the allegation. It was discovered that the fee was automatically billed not at the control of the facility itself. Per interview with the administrator, the fee was pushed out automatically by the corporate billing office, without the knowledge of the facility staff. This is a care based fee not an increase of rent as agreed on admission agreements at time of registration. Upon reporting the fee by the responsible party, and discussions with the administrator, the facility credited the fee to the responsible party. The facilty maintains that they did not enforce the fee due to it being added without their knowledge so the facility credited immediately. LPA met with the dining services director Xuan Tran explained the purpose of today's visit. Administrator Monica Ceron Tapia is not in the facitliy until later today. During the course of the investigaiton multiple interviews were conducted as well as documentation review. Per interviews conducted, it could not be determined if the resident sustained a fracture due to staff neglect due to conflicting information received from the resident. Regarding the personal belongings of the resident, it was found that the facility removed the cigarettes from the room of the resident as a safety precaution and the resident was smoking in the room which is against facility policy. During the course of the investigation LPA conducted multiple interviews with residents and staff and reviewed pertinent documentation received such as resident care plans, reports, and staff scheduling. According to reveiwed items and interviews conducted with staff, the resident is assisted with "toileting" when called for. The facility defines toileting in the case for R1 as the changing of adult diapers as the resident is unable to self toilet. R1 is unable to bear weight or able to ambulate to the toilet with the assistance of staff any longer. LPA met with the executive director Monica Tapia and explianed purpose of today's visit. During the course of the investigation LPA condducted interviews and reviewed the eviction notice provided to the resident. Upon review of the eviction notice, as well as the resident's physician's report, and the facility assessments/reappraisals show that the only basis of eviction states the fact that the resident having dementia is the primary reason. The physicians report (LIC602) and assessment do not state other reasons for eviction. This allegation is substantiated. LPA met with the executive director Monica Tapia and explianed purpose of today's visit. During the course of the investiation LPA Vado conducted multiple interviews and made facility observations. It's discovered that the resdient developed dementia over the time he has resided at the faciltiy. Due to the resident wandering from his room into the facility, also failing to comply with facility sign in and out policy, and leaving the faciilty unsupervised with a formal diagnosis of dementia it puts the resident at risk. The facility does not provide one on one supervision of residents but in order to help with the supervision of the resident, the facility hired a staff person from an outside agency to supervise the resident when he leaves his room. On this day Licensing Program Analyst (LPA) Jaime Vado conducted an unannounced complaint investigation visit to close and deliver findings in regards to the allegation received. LPA met with Wellness Director Baneen Amiri and explained purpose of today's visit. During the course of the investigation LPA interviewed staff and made observations in regards to food storage and supplies. In an interview with the diining director Xuan Tran, it was stated that the milk was not expired. A review of the milk served was made in the food supply and she confirmed it was not expired. It was explained that the milk was left out for the resident for lunch, and the resident did not pick it up. The milk was warm but not expired. The food was not sitting out for a long time but long enough to have the milk get warm. The facility implimented a plan so that the resident's food and milk is not sitting out and the is stored if food if not picked up right away. This allegation is unsubstantiated. During the course of the investigation LPA reviewed the incident report regarding a situation that took place on 8/2/2022. The incident was reported to the Department within the specified time frame required for reporting such incidents. The Department has copies of these incident reports. This allegation is unfounded. This agency has investigated the complaint alleging that the facility did not submit an incident report to licensing . We have found that the complaint was unfounded, meaning that the allegation was false, could not have happened and/or is without a reasonable basis. We have therefore dismissed the complaint.
