On 10/06/2023 at 9:30 AM, Licensing Program Analyst (LPA) Pang Lee arrived unannounced to this facility to conduct a complaint visit. LPA met with administrator, Sarah Weininger and explained the purpose of the visit. The purpose of this visit is to deliver complaint findings for the allegations above. The current census is 61. A brief interview with conducted with administrator. Allegation: Staff did not prevent an adult from being physically combative with resident at the facility. It was alleged that staff did not prevent an adult from being physically combative with residents at the facility. This investigation consisted of records reviewed, interviews with staff, residents, and the residents responsible party. LPA Lee interviewed 9 out of 9 residents who stated residents have not witnessed any adult being physically combative toward residents in care. Furthermore, resident 1 (R1) denies an adult was being combative toward (R1). Licensing Program Analyst (LPA) Christina Valerio and LPA Jamie Ivey Canady arrived unannouced to conduct a 10-Day Visit and complaint investigation. LPAs were met by Executive Director (ED) Sara Weininger and explained the purpose of the visit. The investigation consisted of interviews with staff, interviews with responsible parties, and records review. The department has determined the following as it relates to the allegation: Wrongful Eviction. According to an interview with the ED, there are two residents that have been issued an eviction. Resident 1 (R1) was issued an eviction notice on 02/17/2022 and Resident 2 (R2) was issued an eviction notice on 04/11/2022. Licensing Program Analyst (LPA) Anthony Tuck arrived at the facility unannounced and was met by Administrator Sara Weininger on 12/29/2021. LPA explained the purpose of today's visit to conclude the complaint investigation and review findings for the allegation listed above. LPA conducted a phone interview with RP on 11/17/2021 and on 11/23/2021, LPA conducted an interview with ED on 11/18/2021 and a phone interview on 12/07/2021. LPA conducted a phone interview with W1 on 11/23/2021. LPA received and reviewed copies of documentation for request of records and delivery confirmation of records. Based on interviews conducted and review of supporting documentation, LPA discovered that although copies of requested records were provided to R1’s responsible party, LPA learned that resident records were not provided promptly. The preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. LPA met with Sara Weininger and explained the purpose of today’s visit. Throughout the course of this investigation, LPA Martinez conducted interviews and reviewed facility records. LPA Martinez interviewed residents 1 thru 7. Residents 1 thru 6 reported having no issues with the call button response time, hygiene care, and not being able to go outside. Resident 3 reported she goes out for daily walks around the facility. Additionally, resident 7 reported not having any issues with call button response time, not being able to go outside, and hygiene services. Moreover, during an interview with R7, a care staff arrived at R7's room to give R7 a shower. In addition, LPA Martinez was provided bowel/ bladder and bathing documents, which indicated the various care tasks were being completed. Continued... Licensing Program Analyst (LPA) Sabrina Calzada arrived unannounced on 9/16/2021 to deliver findings to a complaint that was received on 4/28/2020. LPA met with Sara Weininger, Administrator, and explained purpose of inspection. Prior to initiating today's inspection, LPA completed required COVID-19 testing protocols, contacted the facility to confirm there are currently no positive Covid-19 diagnoses, completed a daily self-screening questionnaire for symptoms of COVID-19 infection to affirm no COVID-19 related symptoms and completed a facility risk assessment. Additionally, LPA was screened per Covid-19 precautionary measures upon entering the community. LPA ensured she applied hand sanitizer before entering the facility and the following Personal Protective Equipment (PPE) was worn: surgical Mask. LPA Bruce Jacobs conducted an unannounced visit at the care facility to complete this complaint investigation and deliver findings regarding the allegations listed above. LPA met with Executive Director/Administrator Sara Weininger and disclosed the purpose of the visit. The investigation consisted of site inspections, reviews of the facility and medical records and interviews with facility staff and management. LPA contacted and interviewed other witnesses and obtained and reviewed copies of the resident's file and medical records. The investigation determined that the resident (R-1) had a number of falls during his residence at the care home from February 28, 2020 to October 2020. On two of the falls, the resident may have had injuries and was sent to the hospital for evaluation. On both of these serious falls, the facility submitted special incident reports to the Department and the responsible party and the resident's primary care physician were notified.
