Licensing Program Analyst (LPA) Mary Rico conducted an unannounced visit to investigate and deliver findings on the allegations listed above. LPA met with caregiver Renz Acosta to explain the purpose of the visit, and the Administrator Wendy Uson was contacted and informed. The investigation consisted of staff interviews, resident interviews, and record review. LPA Rico conducted (5) staff interviews and (6) resident interviews. For the allegation, Resident sustained unexplained injury while in care. During staff interviews, 5 out of the 5 staff stated that R1 was having a behavior and had accidentally hit themselves. In addition, 4 out of the 5 staff stated they took the proper protocols for resident safety and reported the incident report to management. Furthermore, 5 out of the 5 staff stated they have not hit their residents and have not witness another staff abuse their residents. Allegation investigated: Staff do not assist the resident with incontinence care. Staff do not provide activities. Staff yell at the resident. Staff misplaced the resident's belongings. Staff do not assist the resident with hygiene.

Licensing Program Analyst (LPA) Ryan Gardner made an unannounced visit to investigate and deliver findings for the allegations listed above. LPA stated the purpose of the visit and was granted entry and met with Administrator Anna Bella Vito. The investigation consisted of a facility tour, resident interviews, staff interviews, and document review. For allegation, Staff do not assist the resident with incontinence care: Interviews with residents and the staff revealed that there are no issues with the staff providing incontinence care to the residents. The staff denied neglecting the resident’s incontinence needs. The staff stated that the resident’s diapers are changed when the residents wake up, after each meal, before bed, as well as more often on an as needed basis. The residents do not have any concerns with their incontinence care being provided by the staff. Licensing Program Analyst (LPA) Jennifer Semin conducted an unannounced visit to the facility to deliver the findings for the above complaint allegation. LPA met with Caregiver, Eddie Dabu. Administrator Anna Bella Vito was notified via telephone. The investigation consisted of interviews and record review. The allegation, Facility is retaining resident requiring a higher level of care. Facility staff stated staff did give R1 their medication and did check their blood sugar. Staff stated staff did not take R1 to any doctor or lab appointments. Staff stated R1 was transported to the hospital per physician’s request and admitted to a higher level of care. R1 could not corroborate or refute the allegation. Based on interviews and documentation, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 6 & Chapter 1) is being cited on the attached LIC9099D.
