Licensing Program Analyst (LPA) Tena Herrera conducted an unannounced subsequent compliant visit to investigate the above allegation. LPA met with Assistant Administrator Jennifer Serrano, and the purpose for todays visit was explained. The investigation consisted of the following: During the initial visit dated 2/20/25 LPA obtained copies of Staff/Resident Rosters and toured facility. During todays visit LPA toured facility, LPA obtained Surveillance Videos via email, interviewed 3 Staff (S1-S3) and 6 Residents (R1-R6). Licensing Program Analysts (LPAs) Luis De Leon, Blanca Gonzalez, and Licensing Program Manager (LPM) Fernando Fierros conducted a follow up complaint investigation for the allegations listed above. LPA arrived unannounced and met with the Administrator Jennifer Serrano. The purpose for the visit was discussed. On 03/10/25, LPA DeLeon conducted the initial visit, during visit, LPA DeLeon owing on today’s visit: LPA along with Assistant Administrator and Operations Manager toured the kitchen and food pantry, including the common dining area. LPA toured kitchen and observed enough food, the meal being served during the lunch hour was also observed and appeared as a well-balanced meal: Baked Chicken, Rice, Mixed Green Salad, and mixed Vegetables. Serving portions were adequate for residents. LPA reviewed the food menu for January-February 2025. LPA obtained copies of the staff and resident roster, admission agreement, eviction letter, facility food menu and food supply orders. LPA met with Louie Mascardo (Administrator) and explained the reason for the visit. The investigation consisted of the following: LPA obtained copies of the resident and staff rosters and interviewed Administrator, Staff 1 - Staff 2 (S1 - S2) and Resident 1 - Resident 5 (R1 - R5). Copies of R1's eviction notice, rent receipts, diapers delivery receipt, physician report, appraisal/needs and services plan, admission agreement, preplacement appraisal information, functional capability assessment and behavior notes. The investigation revealed the following: regarding the allegation "unlawful eviction", it is alleged that R1 was asked to sign a blank piece of paper and was later told that this was an eviction notice because R1 is late in rent and R1 states that is not true and was not given a copy of the notice. On 10/31/22 at 9:17 a.m., Licensing Program Analyst (LPA) Jewel Baptiste conducted an unannounced complaint investigation to the facility. Upon arrival, LPA met with staff #1 (S1) and explained the purpose of the visit. S1 contacted Administrator Luisa Mascardo via phone and LPA explained the reason for the visit. Administrator joined the visit at 10:00 a.m. During today’s visit, LPA toured the facility with the S1 and obtained the resident/ staff roster and inservice trainings for residents personal rights. LPA reviewed the daily progress notes for R1, reviewed and obtained a copy of correspondence between case manager and administrator for R1, and a signed statement from R1 preventing staff from waking R1 for breakfast. The investigation consisted of the following: during the initial televisit conducted on 12/04/20, LPA interviewed the former Administrator Jose Marquez. LPA also obtained copies of staff and resident rosters. During today's visit, LPA toured the facility which included the common areas. LPA also interviewed the current Administrator, Staff #1 - Staff #3 and Resident #1 - Resident # 6. The investigation revealed the following: in regards to the allegation "unqualified staff are providing care and supervision to residents", it is alleged that housekeeping staff is providing personal and hygiene care to the residents rather than properly trained staff.
