Type of visit: Required - 1 Year
Licensing Program Analyst (LPA) Maria (Mita) Partoza conducted an unannounced annual required inspection and met with licensee/administrator (LIC/ADM) Marie Pendar and stated the purpose of the visit. The facility is licensed for adults 60 and over approved for 6 (six) non-ambulatory, 1 maybe bedridden, and hospice waiver for 6. LPA observed 2 residents and 1 staff present. 2 Out of 2 residents were in their respective room resting during the time of the visit. LPA toured the facility, including common areas, resident rooms, kitchen, bathrooms, driveway, and outdoor spaces and storage areas. Indoor temperature was within regulation range of 71°F. The kitchen was sanitary and organized; knives and chemicals were locked. Food supply met requirements (2 days perishable, 7 days non-perishable). Kitchen water temperature measured at 117.7°F. Bathroom water temperature measured at 105.8°F. Bathrooms had grab bars and non-skid mats; resident rooms has storage for personal belongings. Medications were locked and inaccessible to residents; first aid kit was complete. Outdoor areas were free of obstructions and tripping hazards; laundry appliances were functional, and cleaning supplies were secured. Fire, smoke, and carbon monoxide systems were operational; hallways were clear and well-lit. page 1 of 2 see LIC 809C The facility has is equipped with automatic alarm system, there are 6 single occupancy residents room 2 are occupied. All bedroom are equipped with hospital bed with bed rails. The facility has a staff room and office. The exterior has a storage shed by the exterior side. LPA reviewed 2 resident and 3 staff records, including medication logs, admission agreements, care plans, personal and incidentals, health screenings, and training. All staff have required clearances and certifications. Technical assistance provided for record organization of 1 out of 2 resident record and 3 out of 3 staff record. The facility conducts fire and earthquake drill quarterly for each shift. Last drill practice training was conducted on 1/15/2026. The facility is equipped with panel fire alarm system and a fire extinguisher inspected on 06/25/2025. No deficiencies were cited during today's visit based on the California Code of Regulations (CCR) Title 22. Type of visit: Case Management - Other
Licensing Program Analyst (LPA) Christine Kabariti arrived to the facility unannounced to conduct a case management - other visit. LPA met with a staff at the facility and with the Administrator (ADM), Marie Pendar via Facetime. ADM was unable to meet LPA during the time of the visit as the ADM was at a doctor's office picking up another residents medication. The purpose of the visit was to follow-up on a Type A violation that was issued at the facility during the annual inspection on 02/20/2025. During visit, LPA toured the facility with staff to include all the resident bedrooms, staff bed room, common areas, backyard, shed, and garage. There was only 1 resident present with 1 staff member who is fingerprint cleared and associated to the facility's roster. LPA reviewed the facility's LIC500 and interviewed ADM regarding the facility's staffing. Based on record review and interview all staff members who work at the facility are fingerprint cleared and associated to the facility roster. No deficiencies were cited per California Code of Regulations, Title 22. This report was reviewed with ADM Marie Pendar via Facetime and the report was signed by a designated personnel. Type of visit: Case Management - Annual Continuation
On 2/28/2025 - Licensing Program Analyst (LPA) Maria (Mita) Partoza, conducted an unannounced continuation of the required annual inspection and met with the facility administrator (ADM) Marie Pendar. LPA stated the purpose of the visit. LPA observed, 1 staff (ADM) and 1 resident at the time of the visit. LPA Partoza, continued with the annual inspection by reviewing staff and resident records, including, centrally stored medication and destruction records (CSMDR) and facility record. Disaster training was done on 2/14/2025. LPA issued a technical advisory to LIC/ADM for food safety, variation of meals, and protection of the food nutritional values. During today's visit deficiencies were cited based on the observation on 2/20/25 initial annual inspection per California Code of Regulations (CCR) Title 22. An exit interview was conducted with LIC/ADM Marie Pendar and a copy of the report and appeals rights were provided. *The licensee have corrected the deficiencies observed by LPA Kenneth Madrigal and Mita Partoza on 2/28/2025. Type of visit: Required - 1 Year
On February 20, 2025, at 2:25 PM, Licensing Program Analyst (LPA) Kenneth Madrigal and Mita Partoza conducted an unannounced annual inspection visit, and met with Marie Pendar, Administrator (ADM). Upon arrival, Staff 1 (S1) identified themselves and LPAs were granted access to the facility as LPAs explained the purpose of the visit. During the entrance of the inspection, LPAs observed 2 residents and 1 staff. LPA toured the facility inside out with ADM which included the living room, kitchen, dining room, two restrooms, two residents’ bedrooms, and four vacant resident bedrooms. The staff area of the facility was also inspected. The front yard and backyard were inspected. Two-day perishable food supplies and seven-day nonperishable food supplies were observed. LPA observed the cleaning product storage area is locked and inaccessible to residents in care. Room temperature was at 68 degrees F, and hot water temperature was measured at 103.1 degrees F in both resident bathrooms. Based on LPAs observations, food stored in the kitchen freezer has freezer burns, medication storage is not locked which is accessible to residents in care, knives and sharps storage is not locked which is accessible to residents in care, S1 is not associated to the facility, unknown substance stored inside an opened laundry detergent bucket outside in the backyard. ADM stated that there are no chemicals in the bucket. Additionally, an opened soil bag is located outside in the backyard and is easily accessible to residents, floor tiles and two glass windows located outside the backyard is also accessible to residents in care. Fire extinguisher was last serviced on January 12, 2024. The facility was equipped with smoke and carbon monoxide detectors. In today’s visit, the smoke detectors were not tested by Adm. LPA observed facility first aid kit. LPAs will continue the record review for facility fire/earthquake drill log. The facility's last drill was on January 12, 2024. PAGE 1 OF 2. SEE LIC809-C. LPAs interviewed S1 and S1 stated he/she started working at the facility on 2/7/2025 which matches the Personnel Record. Based on record review, S1 is not associated with the facility. ADM stated he/she is in the process of associating S1 to the facility. LPAs informed ADM that based on CCR Title 22 87355 (e) (2) prior working, residing, or volunteering in a licensed facility; Request a transfer of a criminal record clearance as specified in Section 87355 (c). Violation of this section shall result in an immediate assessment of civil penalties of one-hundred-dollar ($100) per violation per day for a maximum of five (5) days by the department and a total of $500. LPAS and ADM informed S1 that they could not be in the facility until the ADM submits the LIC 9182, Criminal Record Clearance Transfer Request Form with required supporting documents to the Department and approved by CDSS. Deficiencies cited today for 87353 (e) (2) based on LPA observations, interviews conducted and record reviews in accordance with the California Code of Regulations (CCR) Title 22. Based on observations, the following deficiencies will be cited in a future date: Operational Requirements - 87706(a)(1)(C) S1 has no training record Physical Plant/Environmental Safety: 87303(e)(3) Water Temperature is not within range. Physical Plant/Environmental Safety 87309(a)(2) Food storage not with labels Physical Plant/Environmental Safety 87309(b)(1) Medication and knives are not locked and secured. The annual inspection will be continued based on observation, record reviews, and findings during today’s visit. This Evaluation Report was reviewed with Marie Pendar, Administrator. Allegation investigated: Staff in the premises without fingerprint clearance
On 7/24/2024 at 9:15 a.m. Licensing Program Analyst (LPA) Maria (Mita) Partoza and Marcela Yanez, conducted an unannounced complaint investigation regarding the above allegation that a staff (S1) was not fingerprinted. LPAs met with adminstrator (ADM) Marie Pendar. LPAs stated the purpose of the visit. The facility is a Residential Care Facility for the Elderly (RCFE) serves adults from 60 years old and above, approved for 6 non-ambulatory and 6 hospice waiver. Based on interview and record review and interview, ADM submitted required forms to Guardian, due to typographical errors, Guardian was not able to process the application. ADM was able to clear the confusion with Guardian and ADM was asked to resubmit the application and provided a PIN to expedite the application. page 1 of 2 Unfounded Based on document review - S1 has a valid fingerprint clearance dated 3/01/2024. The facility number was not correct. During the time of the visit the ADM was able to resolve the problem with Guardian and have corrected the information based on the instruction received by ADM from Guardian. This agency has investigated the complaint alleging staff does not have fingerprint clearance. We have found that the complaint was unfounded, meaning that the allegation was false, could not have happened and/or is without a reasonable basis. No citation was issued during today's visit based on California Code of Regulation (CCR) Title 22. Type of visit: Case Management - Deficiencies
On 7/24/2024, Licensing Program Analysts (LPAs) Maria (Mita) Partoza and Marcela Yanez, conducted an case management - deficiencies during a complaint investigation and discussed the case management deficiencies with administrator (ADM) Marie Pendar. Based on record review and interview, ADM did submit the necessary documents to associate and clear staff (S1) that was previously cited on 2/4//2024. The documents submitted has typographical errors and was not processed by Guardian. Based on interview with ADM, emails were sent but no follow up after the emails. Based on documentation, LPA Monter follow-up with ADM on 2/26/2024, informing ADM that there was error on the information of S1. Based on document review, S1s information was corrected, but the facility number was missing a number. The livescan for S1 was processed but has the wrong facility license number and Guardian was not able to process due to non-follow up from ADM. ADM was able to clear the matter of typographical error with Guardian, and was provided a PIN to process the application and associate S1. Based on interview ADM stated he/she did not receive a notification from Guardian regarding S1. ADM stated he/she is not familiar with Guardian and did not know how to access the website. Based on interview, ADM did not follow up with Guardian for S1s livescan and association. page 1 of 2 LPAs requested a copy of request for live scan, copy of DOJ response, LIC 9182 and a copy of S1s identification and a note to Guardian with PIN for S1. Deficiency is cited during today's visit based on California Code of Regulation (CCR) Title 22. See LIC 809D. Type of visit: Required - 1 Year
Licensing Program Analysts (LPA's) Manuel Monter and Mita Partoza conducted an unannounced annual inspection visit, and met with Administrator (ADM) Marie Pendar. During the visit, LPA observed 2 residents and 1 staff. As LPA's attempted to enter the facility, LPA's observed a locked gate. LPA's rang the button near the black metal door and staff exited the front door and unlocked the metal gate with a key. The metal gate has a dead bolt lock on both sides, requiring a key to open. (Photographs taken.) LPA's asked staff S1 his/her name. LPA's cross referenced residents name with LIS personnel and guardian. S1 is not associated to the facility. S1 stated he/she has been working at the facility since October 2023. ADM stated S1 is not associated at this facility. LPA toured the facility inside out with ADM which included the Living room, kitchen, dining room, 2 restrooms. While touring facility bathroom #2, LPA's observed a spray bottle of Lysol. (Photographs taken.) LPA's toured 6 residents bedrooms. While touring resident bedroom #2, LPA's observed dead flies and cobwebs at the window sill. (Photographs taken.) . The staff area of the facility was also inspected. The front yard and backyard were inspected. While touring the backyard, LPA's observed a mallet, outside of the garage door to the backyard. LPA's also observed a lawn mower and a red container, with gasoline inside, located between the garage door exit to the back yard and the kitchen window. (Photographs taken. ) While touring the backyard, LPA's observed Miracle-Gro plant food and Insect & Fungal disease control spay was observed in the backyard, near resident bedroom #1. LPA's observed a mini electric stove, next to the outlet in the back yard, near resident bedroom #1. (Photographs taken) Two-day perishable food supplies and seven day nonperishable food supplies were observed. LPA observed the medication storage area, knives storage area, and cleaning product storage area as locked and inaccessible to residents in care. Room temperature was at 70 degrees F, and hot water temperature was measured at 108 degrees F in both resident bathrooms. LPA measured facility kitchen sink water temperature, at 142 degrees F. Fire extinguisher was serviced in January 2024. The facility was equipped with smoke and carbon monoxide detectors. Smoke detectors was tested by ADM, and were functional. LPA observed facility first aid kit. LPA requested to review facility drill log. ADM stated she has not conducted a drill yet. LPA reviewed facility records for 2 residents. LPA reviewed 2 resident medications and centrally stored medication records and Medication Administration Record (MAR). While review R1's medication records LPA's observed 2 medication tablets, unsecured in the bottom of the medication container. While reviewing R1's medication records, Medication #1 and Medication #2 was not listed on the Centrally Stored Medication Log. While reviewing facility MAR for R1, LPA's observed the MAR states R1 refused Medication #1 from February 1st to February 8, 2024. ADM stated that was a mistake. LPA requested to review 2 staff records. ADM stated the files were not available. ADM went to get the staff files, which were located at her other facility, at 1:30pm. ADM returned at approximately 1:50pm. LPA reviewed Staff S1 documents. ADM stated she has not updated staff records of S1 and ADM for Marcel's Memory Care. LPA conducted interviews with 1 staff (S1) and 2 residents (R1-R2). Deficiencies cited during today's visit. This report was reviewed with Administrator Marie Pendar and a copy of the signed report was provided. A civil penalty is being assessed for the amount of $500 ($100 per day x 5 days = $500) for S1 working and residing in the facility without association.
