Allegation investigated: Staff handled resident in a rough manner while in care.

Licensing Program Analyst (LPA) Christina Valerio arrived unannounced to the facility to deliver complaint investigation findings. LPA Valerio met with facility staff Ilaisa Niutabua, and explained the purpose of the visit. The investigation consisted of interviews with staff, interviews with residents, and facility record review. The following has been determined as it relates to the aforementioned allegations. According to a report provided to the Regional Office, it was alleged that Resident 1 (R1) was pushed two (2) times by a staff member and had their cathetar ripped from their body. LPA attempted to contact the reporting party three times; however, was unsucessful. LPA Valerio interviewed staff. Staff 1 (S1) reported S1 has not seen any staff hit, push, or yell at residents.S1 reported having a good relationship with all the residents. Continues on LIC 9099 - C... Allegation investigated: Staff inappropriately touched resident

On 2/13/24, Licensing Program Analyst (LPA) Tung Truong conducted an unannounced visit to deliver the findings for a complaint received on 6/9/23. LPA met with facility staff Nepani Tuivu and explain the purpose of the visit. LPA spoke with Administrator Unaisi Waqalala over the phone to discuss the conclusion for complaint and the findings. Administrator Unaisi Waqalala was unable to come to the facility and gave consent for staff to sign today's report. Throughout the course of the investigation, the Department conducted interviews and reviewed records. Based on records review, and staff and resident interviews, there is not a preponderance of evidence to substantiate the allegation mentioned above. The investigation revealed that resident (R1) wasn't sure if staff (S1) was touching R1 for sexual arousal while cleaning R1. R1 reported that S1 never tried to force physically or inserted anything into R1. R1 stated that S1 stopped cleaning R1 when R1 asked S1 to stop. Regarding the allegation that staff did not treat resident with dignity and respect, it was determined that there was insufficient evidence to corroborate the allegation. Resident (R2) and (R3) who were interviewed reported that they did not hear staff yell or speak inappropriately to residents. On 5/18/2023, Licensing Program Analyst (LPA) Tung Truong conducted an unannounced visit to this facility to deliver the complaint findings. LPA met with Administrator Unaisi Waqalala and explained the purpose of the visit. Throughout the course of the investigation, LPA conducted interviews and reviewed records. Regarding the allegation that staff hit resident, it was learned that facility staff (S1) did not hit resident (R1). Based on staff interview, S1 denied hitting R1 and stated that it was R1 that hit him. Moreover, resident (R4) who witnessed the incident corroborated that it was R1 that hit the staff. Based on information gathered, LPA finds the allegation above to be UNFOUNDED. A finding that the allegation is unfounded means that the allegation is false, could not have happened, and/or is without a reasonable basis. LPA met with Administrator Unaisi Waqalala and explained the purpose of the visit. Throughout the course of the investigation, LPA Truong conducted interviews and reviewed facility documents. Based on interviews and statements obtained during the investigation process, it was determined that there was insufficient evidence to support that staff mishandled a resident's medication while in care. According to staff interviewed, R1 likes to dictate his medication. Per staff, 3 attempts were made to give R1 the antibiotic after being discharged from the hospital on 12/30/2022. However, R1 refuses and only starting to take the antibiotic after talking with his doctor on 1/3/2023. LPA spoke with R1 for a statement; R1 stated that he doesn't remember as he has gone to the hospital several times. Licensing Program Analyst (LPA) Tung Truong arrived at the facility unannounced on 10/21/22 at 10:45 am to open the complaint with the allegation above. Upon LPAs arrival, Caregiver Tavaita Seruvatu was present at facility and contacted Administrator Unaisi Waqalala. LPA spoke with Administrator Unaisi Waqalala over the phone and explained the purpose of the visit. Administrator was advised of the complaint allegation mentioned above. Throughout the course of the investigation, LPA conducted interviews and reviewed records. Based on statements obtained, it was learned that resident (R1) was issued a 30-day eviction notice on 7/25/22. Upon review, it was determined that a 30-day notice was issued in accordance with Title 22 regulations. Administrator Unaisi stated she is not pursuing the unlawful detainer of R1 and is looking for resources to assist R1 with placement at the moment. On 7/28/22, Licensing Program Analyst (LPA) Tung Truong conducted an unannounced visit to this facility to deliver the complaint findings. LPA met with Administrator Unaisi Waqalala and explained the purpose of the visit. Throughout the course of the investigation, LPA conducted interviews and reviewed records. Based on statements obtained, it was learned that there was no physical altercation between residents. Residents and staff who were interviewed stated no fight has occurred in the facility. It was learned that on 6/12/22, resident (R3) came out of his room and began throwing and breakings things throughout the facilty. R3 also tried to attack resident (R4); however, staff was able to redirect R3 on time and tries to calm R3 down. 9-1-1 and EMT was called, and R3 was taken to the hospital for evaluation.
