On 10/3/24, Licensing Program Analyst (LPA) Tung Truong conducted unannounced visit to complete and delivery findings for a complaint investigation received on 8/26/24 with the allegations above. LPA met with Director of Care Giam Alviedo and discussed the conclusion for complaint and the findings. Throughout the course of the investigation, LPA Tung Truong and Pang Lee toured the facility and observed bedrooms, kitchen, living area, and laundry area. LPAs conducted interviews with residents and staff and reviewed records. Based on observations, interviews and record reviews, there is insufficient evidence to support the allegations “Licensee does not ensure that resident(s) are provided safe, healthful and comfortable accommodations, furnishings and equipment” LPAs observed the facility is clean and well maintained. Allegation investigated: Personal Rights: Staff discarded resident’s personal items without authorization.

Licensing Program Analyst (LPA) Kevin Gould conducted an unannounced complaint inspection at Mercy McMahon Terrace on 12/29/23 at 1:30pm to inform the licensee of complaint allegation mentioned above. Based on the interviews and statements obtained during the investigation process, the allegations cannot be substantiated. LPA conducted interviews with the concerned party (RP) who admitted to moving all items out of the facility prior to her scheduled move out day after providing a 30 day notice to the facility of their intention to move out of the facility. RP states she did return to clean her old room and remove some items from the refrigerator and observed the room had alreadybeen cleaned and had begun to be prepped for a new resident. RP was concerned she would be charged additional fees for cleaning/paining and the return of their alert pendant. LPA Martinez met with Dee Aponte and explained the purpose of the visit. Throughout the course of the investigation, the Department conducted interviews and reviewed documents. Based on the investigation, it was learned facility staff reported resident 1’s (R1) change of condition in a timely manner and addressed the change in condition. In addition, witness 1 (W1) reported no issues with reporting R1’s change in condition. It was also determined R1 was not physically abused by facility staff. W1 also reported they did not believe R1 was physically abused. As a result, there was not enough evidence to meet the preponderance evidence to prove R1 was physically abused by the facility care staff. Licensing Program Analyst (LPA) Avelina Martinez arrived at the facility unannounced on 10/12/2022 at 12:45 PM to deliver complaint findings, LPA met with Mary Erickson and explained the purpose of the visit. Throughout the course of the investigation, LPA conducted interviews and obtained facility documents. It was learned on one occasion a staff member was not wearing a masks during their shift. Facility management was made aware, and facility management addressed the mask issue and provided training. Moreover, during interviews, it was also learned that care staff have been informed to wear their mask during all shifts. As a result of this investigation, the Department finds this allegation to be Substantiated. A finding that the complaint is substantiated means that the allegation is valid because the preponderance of the evidence standard has been met. On 05-26-2022 at 8:30 am, Licensing Program Analyst (LPA) Avelina Martinez conducted an unannounced facility visit in regards to a complaint investigation with the above allegation. LPA met with Mary Erickson and explained the purpose of today's visit. Throughout the investigation, LPA Martinez conducted interviews and toured the facility. LPA Martinez was informed by staff and residents that there were no issues with leaving the facility and reentering the facility. In addition, residents can inform their caregivers that they are leaving the facility, and to meet them at the front lobby at a certain time (upon return). Moreover, residents who leave the facility to sit at the front sitting area can push their pendent buttons when they are ready to reenter the facility, and a caregiver will escort them to their rooms.
