On 06/04/2025, Licensing Program Analyst (LPA) V. Gorban conducted an unannounced subsequent complaint investigation to deliver findings. LPA explained the purpose of visit to lead staf Julius Cadiente. During the course of the investigation, LPA conducted a facility conducted a facility tour, interviewed residents, and reviewed records. The Department has investigated the allegation: Staff did not follow appropriate eviction procedures with resident in care. Based on records reviews and staff interviews it was discovered that facility staff did not comply with regulation regarding residents’ eviction process. Records revew indicated that on 04/01/25 resident was brought back to the hospital and have not returned back to facility with no eviction notice provided. Based on interviews and records review, the preponderance of evidence standard has been met therefore the allegation is SUBSTANTIATED. A deficiency is being cited on the 809D. On 7/31/2023, Licensing Program Analyst(LPA) D. Ayers arrived at the facility unannounced to deliver complaint findings. LPA spoke with Administrator Cecilia Candido and announced the purpose of the inspection. Administrator agreed that staff could sign the report on her behalf. LPA conducted a tour of the facility, interior and exterior to ensure there are no potential or immediate health and safety risk at the facility. During the course of the investigation, the department inspected the facility, conducted interviews, and reviewed records. During inspection on 6/21/2023 and 7/31/2023, the facility was observed to be adequately lit and generally free from odor. Based on the interviews conducted, documentation obtained and reviewed, and the information received during this investigation, the preponderance of evidence standard has not been met; therefore, the above allegations are found to be unsubstantiated at this time. LPA met with Elsa Rubio, Administrator, Cecilia Candido was notified by phone that licensing is present and arrived shortly. Staff violated personal rights- “I don’t remember saying that”, Rp stated and could not comment in regard to this allegation. This agency has investigated the complaint alleging “Staff violated personal rights”. Due to medical staff error, order was reordered on 10/06/22. Based on the interviews conducted and records review the above allegation is UNSUBSTANTIATED. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is unsubstantiated. Licensing Program Analyst (LPA) Lady Cabrera conducted the complaint investigation visit to the facility. LPA met with Gerald Cadiente, Assistant Administrator due to Administrator Cecilia Candido was unavailable. LPA spoke with Designated Representative Nikolas Adamsson and stated the purpose of the visit. LPA went over the allegation and the finding with Designated Representative via telephone call. Designated Representative approved for Gerald Cadiente to sign the report. During the course of this complaint investigation LPA interviewed staff on duty and obtained and reviewed facility records. It was determined based on the interviews and records review that the above allegation is SUBSTANTIATED. On 04/09/2022, Resident (R1) was signed out by their responsible party.
