Licensing Program Analyst (LPA) Bennette Pena conducted an unannounced complaint visit regarding the above stated allegation.LPA met with Administrator, Virgilio Agas and explained the reason for the visit. The investigation consisted of the following: LPA obtained copies of Resident & Staff Rosters. LPA toured the facility including the common areas. LPA reviewed and obtained copies of the following documents: Visitation policy, House rules, Sign in/out sheet (November 2025), files of Resident #1 (R1) Identification and Emergency Information/Face sheet, Pre-appraisal information, Appraisal Needs and Services Plan, and Physician's Report, Staff #1 (S1) files such as Criminal Background/Exemption (August 13, 2024), Court proceedings (June 27, 2024), Unusual Incident/Injury Report (SIR dated 11/03/2025), and text message screenshot (Nov. 2025). Between 10:00am - 12:15pm, LPA interviewed Staff #2 (S2) - Staff #6 (S6) and Resident #1 (R1) - Resident #7 (R7). Allegation investigated: Staff speak to a resident in an inappropriate manner.
Licensing Program Analyst (LPA) Alberto Lopez conducted subsequent unannounced complaint visit to deliver findings for the above allegations. LPA met with Gretchen Ilagan, Med- Tech and discussed the purpose of the visit. On 11/04/2025 LPA interviewed nine (9) (staff S#1 - S#9), eight (8) residents (R#1 - R#8), LPA obtained copies of the following documents: staff roster, resident roster, R2 ‘s physicians report, and appraisal needs and service plan. LPA also inspected five (6) random rooms and took tour of common areas. The investigation revealed regarding allegation: Staff speak to a resident in an inappropriate manner. It is alleged that staff member spoke to resident inappropriately. LPA interviewed eight (8) residents and six (6) of eight (8) residents could not corroborate the allegation. LPA interviewed nine (9) staff and seven (7) of nine (9) staff denied the allegation. Licensing Program Analyst (LPA) Tena Herrera made an unannounced subsequent visit at the facility to investigate the above-mentioned allegation. LPA met with Administrator Virgilio "Gil" Agas, and explained the purpose for the visit. On 4/14/25 LPA Nune Margaryan conducted an initial visita and obtained a copy of resident/staff rosters, conducted a tour of physical plant and common areas with Administrator, and obtained the following documents from Resident #1(R1) file. From 2/14/25 to 3/25/25 an investigator from the Investigations Bureau (P.Miles) conducted an investigaion and sent complaint back to the Regional Office for further investigation. During todays visit 9/22/25 LPA Herrera conducted a subsequent visit, obtained copies of the staff/resident rosters, copy of Special Incident Report (SIR) from R1's file, toured facility, interviewed 3 staff (S1-S3) and 9 residents (R1-R9). Licensing Program Analyst (LPA) Tena Herrera made an unannounced subsequent visit at the facility to investigate the above-mentioned allegation. LPA met with Administrator Virgilio "Gil" Agas, and explained the purpose for the visit. On 5/30/25 LPA Nicol Wesley conducted the initial visit and obtained copies of the staff/resident rosters, requested a log for the individuals who can not schedule/arrange medical appointments, interviewed staff and residents. During todays visit 9/22/25 LPA Herrera obtained copies of the staff/resident rosters, copy of Resident #1's (R1) Hermodialysis Flowsheets for the month of May 2025 were provided, LPA toured facility, interviewed 3 staff (S1-S3) and 9 residents (R1-R9). The investigation consisted of the following: LPA Vaid requested, obtained and reviewed the staff/ residents roster, face-sheet, physicians report, medications list, admissions agreement, IPPs and pre-appraisals for two (2) residents’. Contact information for R1s ALW coordinator. Copy of residents LIC 621. Hospice care plan for two (2) residents. Toured the facility interviewed staff/residents. Did not observe any health and safety concerns. Regarding the allegation: Staff did not safeguard resident's personal belongings.
