Allegation investigated: Facility using postural support as a restraint

Licensing Program Analyst (LPA) Christi Coppo arrived at this facility unannounced, to open an investigation into the above allegation. LPA met with Claribel Kemper, assistant to the Administrator. Administrator David Vibeat not available to come to the facility but was available by phone and gave Admin assistant permission to sign report. Complaint alleges facility using postural support as a restraint. Upon arrival, LPA observed resident (R1) in wheelchair with gait belt being used as restraint. LPA obtained photographic evidence of restraint. Gait belt was fastened, threaded, and tied with belt release placed behind resident in back of the wheelchair, inaccessible to resident to release. Allegation investigated: Staff left resident in soiled diaper

Licensing Program Analyst (LPA) Hansen conducted a complaint investigation regarding the allegation listed above. LPA arrived unannounced on this day for the purpose of delivering findings of the above complaint allegation and met with staff Magno “June” Privado & Gerry Ofiaza. Staff called Licensee/Admin Roa Francisco who authorized staff to sign and informed LPA requested documents (602 for R1 & Lib Ins) are not available. Staff left resident in soiled diaper – Complaint alleges resident (R1) was in facility approximately 24 hours and did not have incontinent care needs met, left in soiled undergarments. LPA confirmed through staff interview R1 was in facility approximately 24 hours and was not provided incontinence care or assistance to the bathroom. LPA obtained police report regarding incident which supports R1’s incontinent care was not met. Additionally, per interview, staff was not provided a care plan and or Physicians Report by Licensee/Administrator. LPA Willis arrived unannounced to deliver findings regarding the above mentioned complaint allegation and met with caregiver, Privado Magno. Licensee, Francisco Roa arrived later. During investigation. LPA conducted file review and spoke with Licensee. Facility did not issue a refund – Complaint alleges that upon death of a resident, the responsible party was not provided a refund. Complaint goes on to allege that when a refund was requested, the facility refused to issue a refund prompting the responsible party to leave the resident’s personal belongings in their room. When responsible party came to pick up personal belongings at the end of the month, resident’s belonging had been removed from the resident’s room and put in the garage. Interview with Licensee confirmed that they did refuse to issue a refund to responsible party and confirmed that they removed the resident’s personal items from their room and placed them in the garage.
