At 09:15am, Licensing Program Analyst (LPA), Angela Panushkina and Licensing Program Manager (LPM), Nichelle Gillyard conducted an unannounced visit in response to the above-mentioned allegation. LPA/LPM met with the Staff #1 (S1), who granted access to the facility. Administrator was contacted and the reason for the visit was explained. At 09:20am, LPA/LPM requested resident and staff roster. At 9:25am requested copies of pertinent information which include, but not limited to Physician’s report, Admission Agreement, Appraisal Needs and Services Plan, Resident Daily Log, relevant to the investigation. At approximately 9:30am, LPA/LPM conducted a physical plant tour, to ensure health and safety of the residents are protected. Between 9:50am – 11:00am, LPA/LPM interviewed one (1) staff, three (3) residents and one (1) witness. This is an Amendment to the original report issued 05/16/2024. Additional information was added to clarify the investigation. At 10:00am, Licensing Program Analyst (LPA) Angela Panushkina conducted an unannounced initial complaint visit at this facility to investigate the above allegation. LPA met with the Administrator and explained the reason for the visit. During course of the investigation, interviews and record review were made. At 10:05am, LPA requested resident and staff roster. At 10:10am, LPA requested copies of pertinent information which include, but not limited to Admission Agreement, Physician’s Report, Appraisal Needs and Services Plan, Eviction Letter, etc., relevant to the investigation. At approximately 10:15am, LPA conducted a physical plant tour, to ensure health and safety of the residents are protected and physical plant is in compliance with Title 22 Regulations. Licensing Program Analyst (LPA) Rosaura Valenzuela made a subsequent visit to deliver the findings for the above noted allegation. LPA met with Administrator Myline Olivas. The purpose of the visit was discussed. It was alleged that Licensee failed to obtain timely medical care for Resident #1 (R1). To investigate this allegation on 4/19/2021 at 2:21pm, staff interviews were initiated. Staff interviews revealed that R1 was assessed after the fire department left. Staff did not assess R1 before the fire department came, due to Staff #1 (S1) being alseep. On 10/25/2022 between 3:30pm and 4:00pm, LPA reviewed a copy of the Emergency Medical Services report and it stated that R1 was found on the ground and unable to get up. Fire department assessed R1 and helped them get up back to the bed. Based on interviews and records review, there is sufficient information to substantiate this allegation. Licensing Program Analyst (LPA) Rosaura Valenzuela made a subsequent visit to deliver the findings for the above noted allegations. LPA met with Administrator Myline Olivas. The purpose of the visit was discussed. It was reported that there were was a lack of night supervision at the facility on 4/05/2021. To investigate this allegation on 4/19/2021 at 2:21pm, staff interviews were initiated. Interviews revealed that Staff #1 (S1) was tired and fell asleep while on duty. On 10/25/2022 between 3:30pm and 4:00pm, LPA reviewed a copy of the Emergency Medical Services report and confirmed what staff reported to LPA. On 4/05/2021 at 1:46am the L.A. Fire Department was called and upon their arrival at 1:51am, they were not able to get staff to open the front door. They entered through a back sliding glass door and found staff asleep. Based on interviews and records review, there is sufficient information to support this allegation. Therefore, this allegation is SUBSTANTIATED at this time. On 09/29/22 Licensing Program Analyst (LPA) Joscelyn Martinez arrived at the facility to conduct an unannounced complaint investigation. Upon arrival LPA met with house manager and later met with administrator Myline Olivas. The purpose of the visit was explained. Allegation: Residents are not accorded privacy in their rooms. It is alleged that staff are sleeping in resident’s room or in empty rooms. To investigate this allegation LPA conducted interviews with staff, residents, and toured the facility. Interviews with five (5) out of six (6) residents stated staff do not sleep in their room and are accorded their privacy. One (1) out of six (6) resident was unable to respond to any questions asked. LPA observed five (5) bedrooms in the home of which one (1) is designated for staff use. All five (5) bedrooms were toured. Two (2) bedrooms are shared and two (2 ) bedrooms are for single use. At approzimately 10:00 AM on 02/10/2022, Licensing Program Analyst (LPA) Nicholas Reed conducted a subsequent complaint investigation. LPA met with Administrator and disclosed the reason for the visit. Sexual Abuse Regarding the allegation of sexual abuse, it was alleged Resident #1 (R1) tried to molest Resident #2 (R2) on the evening of 12/27/2021. To investigate the allegation, LPA interviewed staff and residents during an initial complaint investigation on 12/30/21. Based on interviews, R1 often wandered in the facility to the point that the facility installed motion detectors in the hallways. At R2’s request, the motion detectors were turned off and R2’s door was open. R1 entered R2’s room and touched R2’s hand, though the touching was not sexual. Based on information obtained, there was not enough evidence to support the allegation of sexual abuse, so the allegation is deemed unsubstantiated.
